Supreme Court of India building in Delhi, amid protests on which the Bombay Lawyers Association passed a resolution

Mumbai: Demanding the immediate removal of what it describes as unconstitutional restrictions on public protests and individual movement imposed by governments, the Bombay Lawyers Association has condemned them in a resolution on the Delhi protests called by the Cockroach Janta Party [Resolution of the Bombay Lawyers Association on restrictions on protests and movement].

What led to the resolution, and the other side

The Cockroach Janta Party had called a protest in Delhi on October 10, demanding the resignation of the Chief Election Commissioner in the context of the Special Intensive Revision of electoral rolls. Delhi saw Metro station closures, train cancellations and detentions, and on October 9 the Supreme Court recorded that there shall be no complete prohibition on movement of Metro and trains. Delhi Police has described the detentions as preventive, citing public safety and traffic management, while the Election Commission and the BJP deny wrongdoing in the revision. These positions have not been tested, and the Court has expressed no view on the merits of the protest or the restrictions.

The resolution as reported

Its wording, as reported, includes:

“By imposing undeclared emergency, it reminds us of emergency days.”

The full text of the resolution has not been made available, and its other terms and date have not been reported. The characterisation is the association’s own.
