Mumbai: Every matter pending before Court No. VI of the National Company Law Tribunal’s Mumbai Bench has been transferred to Courts I to V, as the Tribunal temporarily suspended that court’s functioning with effect from October 13, 2026, until further orders [Administrative Order, File No. 07/16/2026-NCLT (MUM)].
The administrative order dated October 9, 2026 was issued with the approval of the Hon’ble President, NCLT, in exercise of powers under Rule 16(d) of the National Company Law Tribunal Rules, 2016.
Who gets which cases
Annexed to the order are lists of pending matters under Sections 7, 9, 10 and 95 of the Insolvency and Bankruptcy Code, 2016 (IBC). The matters under Section 7 (financial creditors) and Section 9 (operational creditors) are split into five serial-number blocks, one for each of Courts I, II, III, IV and V. The few matters under Section 10 and Section 95 are likewise spread across the five courts.
Court officers have been told to hand over and receive the case records, and to list each matter on its next date of hearing as per the last order sheet.
The operative line
In view of the vacancies to the post of Members at the National Company Law Tribunal, Mumbai Bench, the functioning of Court no. VI Mumbai Bench is temporarily suspended, w.e.f. 13.10.2026, until further order.
Neither the number of vacant posts of Members nor the date on which Court VI is expected to resume is stated in the order.
What litigants should expect
Insolvency litigants whose cases were before Court VI should expect a different court to hear them from October 13, with listing following the last order passed in each case.
The suspension is administrative and records no view on any pending case. How long it lasts depends on the filling of Member vacancies, which the order leaves open.
