The Bombay Bar Association condemned alleged threats, intimidation, and attacks targeting retired Bombay High Court judge Gautam Patel and his family over the Dawoodi Bohra succession judgment. Calling it a direct assault on judicial independence and the rule of law, the Association demanded accountability and protection.

The Bombay Bar Association (BBA) has strongly condemned a series of alleged threats, acts of intimidation, and violent attacks directed at retired Bombay High Court judge Gautam Patel and members of his family in connection with his landmark 2024 judgment in the long-running Dawoodi Bohra succession dispute. In a resolution passed on June 8, 2026, the Association described the incidents as a direct challenge to judicial independence and the rule of law.
The Bar Association noted reports indicating that one of Justice Patel’s family members had suffered physical injuries during one such incident, making the matter particularly serious and deserving of urgent attention from both Indian and foreign authorities. The resolution expressed concern that attacks targeting judges and their families have consequences extending far beyond the individuals involved, as they undermine public confidence in the justice delivery system itself.
The resolution states,
“Violence or threats of violence against judges or their families strike at the very heart of judicial independence and constitute a blatant assault on the rule of law. Such conduct is not merely an attack upon an individual Judge; it is an attack upon the institution of the judiciary and the constitutional promise that disputes will be resolved by courts free from fear, favour, affection or ill-will,”

The Association emphasized that in a constitutional democracy, disagreement with judicial decisions must be addressed through lawful mechanisms provided under the legal system. It stressed that parties aggrieved by court rulings have the right to pursue appeals and other legal remedies, but any attempt to influence judicial outcomes through intimidation or violence is fundamentally incompatible with democratic values.
The resolution said,
“Resort to threats, intimidation, coercion or violence against judges or their families has no place in a civilised society and cannot be tolerated,”
The controversy gained wider attention after reports emerged that Justice Patel’s daughter was assaulted in London by an unidentified masked individual. According to reports, she sustained a fractured nose during the attack. The incident prompted concerns that the violence may have been linked to the highly sensitive litigation over which Justice Patel had presided while serving on the Bombay High Court.
Reacting to the incident, Justice Patel reportedly described the attack as an assault not merely on his family but on the judiciary as an institution. He suggested that the perpetrators appeared to be targeting the credibility and integrity of the judicial process itself.
The judge said,
“This is an assault on the judiciary. They are questioning the integrity of the system. Because this is about a case. The appeal is pending. If such things happen,”
In light of the reported attack, the BBA called upon law enforcement agencies to conduct a comprehensive investigation, identify those responsible, and ensure that appropriate legal action is taken. The Association further urged authorities to implement adequate security measures to protect judges and their families from threats and acts of violence.
The Bar Association also requested that the Ministry of External Affairs engage with British authorities to ensure the safety and security of Justice Patel’s family members residing in the United Kingdom.
Background: The Dawoodi Bohra Succession Dispute
The controversy traces its roots to one of the most significant religious succession battles in modern Indian legal history. The dispute arose following the death of Mohammad Burhanuddin, the 52nd Syedna and spiritual leader of the Dawoodi Bohra community.
Following his demise, his son, Mufaddal Saifuddin, assumed leadership as the 53rd Syedna. However, his claim was challenged by Khuzaima Qutbuddin, the half-brother of the late Syedna, who contended that he had been validly designated as the successor.
As competing claims emerged, the matter eventually reached the Bombay High Court in 2014. What followed was one of the longest and most closely watched civil trials in recent years, involving extensive documentary evidence, witness testimony, and examination of centuries-old religious traditions governing succession within the Dawoodi Bohra community.
The proceedings continued for nearly nine years before Justice Patel delivered his judgment on April 23, 2024. In a detailed ruling, he concluded that Mufaddal Saifuddin had successfully established his claim and was the lawful and rightful 53rd Dai al-Mutlaq and spiritual head of the Dawoodi Bohra community.
Despite the High Court’s ruling, the dispute has not reached its final conclusion. The judgment remains under challenge before a Division Bench of the Bombay High Court, where the appeal is presently pending consideration.
It is against this backdrop that the allegations of threats and attacks have assumed significance. Members of the legal fraternity have expressed concern that attempts to intimidate a judge or his family over a judicial decision could have a chilling effect on judicial independence and the administration of justice.
The Bombay Bar Association’s resolution underscores the broader constitutional principle that judges must be able to decide cases freely and impartially, without fear of retaliation. By calling for a thorough investigation and enhanced protection measures, the Association has sought to reaffirm the importance of safeguarding the independence and integrity of the judiciary in a constitutional democracy.
