Expelled BJP leader Kuldeep Singh Sengar has approached the Supreme Court seeking bail in the custodial death case of the Unnao rape survivor’s father. The apex court will hear the plea on Monday as Sengar continues to serve a 10-year sentence in the case.

Expelled BJP leader Kuldeep Singh Sengar has approached the Supreme Court of India seeking bail in the custodial death case related to the father of the Unnao rape survivor.

According to the case details, the Supreme Court is scheduled to hear Sengar’s plea seeking bail on Monday.

Earlier, on January 19, the Delhi High Court had refused to suspend the 10-year jail sentence awarded to Sengar in the custodial death case. The High Court rejected his request on the ground of delay in the trial and observed that the delay was partly caused due to the several applications filed by Sengar himself during the proceedings.

Sengar was sentenced on March 13, 2020, by a trial court to 10 years of rigorous imprisonment in the custodial death case. Along with the jail term, the court also imposed a fine of ₹10 lakh. While delivering the sentence, the trial court clearly stated that “no leniency” could be shown in a case involving the killing of a family’s “sole bread earner”.

The trial court, however, did not convict Sengar for murder in the case related to the death of the survivor’s father. Instead, it held him guilty of culpable homicide not amounting to murder. The court noted that although the offence resulted in death, there was no intention to kill, and therefore awarded him the maximum punishment prescribed under that offence.

Meanwhile, Sengar’s appeals are still pending before the High Court. These include his appeal against the December 2019 judgment in the main rape case, in which he was convicted and sentenced to imprisonment for the remainder of his life, as well as his appeal in the custodial death case.

In a significant development earlier, the Delhi High Court had suspended Sengar’s sentence in the rape case on December 23, 2025, until the final disposal of his appeal challenging both his conviction and sentence in that matter. However, the Supreme Court later intervened and stayed the High Court’s order suspending his sentence on December 29, 2025.

With the latest plea now before the apex court, the Supreme Court will decide whether Sengar deserves bail in the custodial death case while his appeals continue to remain pending.
