The Supreme Court dismissed Umar Khalid’s review petition, refusing to reconsider its earlier decision denying him bail. The Court reiterated that long jail time alone cannot be a valid reason for granting bail in serious cases.

The Supreme Court of India on Monday dismissed the review petition filed by student activist Umar Khalid, who is an accused in the 2020 Delhi riots case. Khalid had approached the Court seeking a reconsideration of its earlier judgment that denied him bail.
After examining the plea, the Court made it clear that there was no reason to interfere with its previous decision. The bench stated,
“Having gone through the review petition and the documents on record, we do not find any valid ground to review the judgment dated January 1, 2026. Accordingly, the review petition is dismissed.”
Earlier, in its January 1, 2026 judgment, the top court had refused to grant bail to Khalid while extending relief to five other co-accused in the same case.
The Court had taken a strong view on the argument of long detention and clarified that delay in trial alone cannot be used as a ground for bail. It had observed that prolonged incarceration, even before the formal commencement of trial, cannot be treated as a “trump card” or a “gateway to bail.”
Khalid has been booked under the stringent provisions of the Unlawful Activities (Prevention) Act (UAPA) in connection with the larger conspiracy angle in the 2020 Delhi riots case. The case relates to allegations of a planned conspiracy behind the violence that took place in Northeast Delhi in February 2020.
With this latest order, the Supreme Court has once again reaffirmed its earlier stance, leaving Khalid without bail relief for now. The dismissal of the review petition means that the previous judgment continues to stand, and Khalid will remain in custody as the trial process moves forward.
