The Supreme Court agreed to revisit the legal test for bail under the UAPA while hearing Umar Khalid’s case, sending the issue to a larger bench. The move comes amid conflicting rulings on bail standards in UAPA cases.
The Karkardooma Court refused interim bail to Umar Khalid in the 2020 Delhi riots conspiracy case, rejecting his plea seeking temporary release to care for his ailing mother and attend the Chehlum ritual of his deceased uncle.
The Supreme Court of India reiterated that bail, not prolonged detention, should remain the norm even under the UAPA, while granting relief to Syed Iftikhar Andrabi and expressing reservations over denial of bail to Umar Khalid.
The Supreme Court dismissed Umar Khalid’s review petition, refusing to reconsider its earlier decision denying him bail. The Court reiterated that long jail time alone cannot be a valid reason for granting bail in serious cases.
