EXCLUSIVE | Kolkata Law College Gang Rape | "If Justice Is Silenced, No Woman Is Safe": Supreme Court Lawyer Urges CJI To Take Suo Moto Cognizance

NEW DELHI: In a powerful move for justice, Supreme Court lawyer Mr. Satyam Singh has written a suo moto letter petition to the Chief Justice of India B.R. Gavai on 30th June 2025, demanding urgent action in the horrific gang rape of a 24-year-old lady law student in Kolkata.

The incident reportedly took place on 25th June 2025 inside South Calcutta Law College and has shaken the legal community and the nation.

According to Mr. Singh, this crime is not just a brutal attack on one individual, but a direct assault on the entire legal profession and the values of justice. He has urged the Hon’ble Supreme Court to take immediate suo moto cognizance and to transfer the investigation to the Central Bureau of Investigation (CBI), monitored directly by the court.

He writes that the victim, a first-year law student, was allegedly gang raped by four individuals:

The accused reportedly threatened her, stripped her clothes, and assaulted her. Medical reports confirmed the injuries, and the police recovered hair strands, unknown liquids, and a hockey stick from various spots, showing evidence of a struggle.

Mr. Satyam Singh reminded the court that he was earlier involved in the 2024 RG Kar Medical College rape-murder case, which brought significant safety reforms for doctors. He also represents the Federation of Resident Doctors Association and has taken up various cases concerning the rights of para-athletes, digital freedom, and COVID-19 transparency.

In his words, he is known as

“The advocate who never backed down from a fight for justice.”

Disturbingly, instead of supporting the victim, senior TMC leaders including Kalyan Banerjee (MP) and Madan Mitra (MLA) allegedly made public statements that shamed the victim and questioned her character. Mr. Singh stated that this has created a “chilling effect” for women lawyers and legal professionals across West Bengal.

He referred to the repeated failure of West Bengal’s governance under the TMC regime to ensure women’s safety, especially after the RG Kar case, highlighting a pattern of political shielding.”

He quoted previous landmark judgments to support court-monitored investigation:

“Monitoring of criminal investigation is the function of investigating agency and not that of the court… But unsolved crimes, unsuccessful prosecution, unpunished offenders and wrongful convictions bring our criminal justice system in disrepute… When the persons involved in the crime wield political power and influence, the possibility of putting pressure on the investigating agency, which is no more independent in our country, is much more.” – Shahid Balwa v. Union of India

He further added:

“The courts, and in particular the High Courts and the Supreme Court, are the sentinels of justice and have been vested with extraordinary powers of judicial review and supervision to ensure that the rights of the citizens are duly protected.” – Romila Thapar v. Union of India

Mr. Singh also cited the recent Bilkis Bano judgment:

“The judgment prioritized the rights and dignity of rape survivors over administrative convenience or political considerations.”

He warned that the accused persons’ political affiliations could influence the investigation, and such bias will weaken public faith in the legal system. He said the case shows similarities with the 2022 Nirbhaya case and demanded swift judicial intervention to stop the cycle of political protection and systemic failure.

Additionally, he emphasized how the failure to implement the Aparajita Bill, passed by the West Bengal Assembly to ensure tougher action against sex offenders, has worsened women’s safety.

In his petition, Mr. Satyam Singh made several requests to the Hon’ble Supreme Court:

Satyam Singh stressed that:

“Proper and uninfluenced investigation is necessary to bring about the truth. Truth will be a casualty if investigation is derailed due to external pressure and guilty gets away from the clutches of law.”
