New Delhi: Ratna Singh, legal affairs head of the Cockroach Janta Party (CJP), has failed to persuade a Delhi court to order registration of an FIR against policemen she accuses of wrongfully confining her and restraining her from going to a protest against Chief Election Commissioner Gyanesh Kumar over the Special Intensive Revision (SIR). The court rejected her plea on Saturday. [Ratna Singh v. State (NCT of Delhi)]
Chief Metropolitan Magistrate Abhinav Pandey of the Saket Courts passed the order, with advocate Adit S Pujari appearing for Singh. The reasons for rejecting the plea, any submissions by the police and the next hearing date, if any, have not been reported so far.
The Backdrop: Detentions Near The Supreme Court
The application follows the detention, by Delhi Police and CRPF personnel near the Supreme Court, of lawyers protesting against the Chief Election Commissioner and the SIR. The detained advocates were taken to the Yamuna Sports Complex. The Supreme Court Bar Association wrote urgently to Chief Justice of India Surya Kant over the detentions, and the CJI is reported to have communicated to the authorities that the lawyers should be released. Delhi Police has earlier described such detentions as preventive measures to maintain law and order.

What Singh Told The Court
Singh stated in her application that she was on her way to the Supreme Court with two fellow advocates to join a lawyers’ protest, and that “she was not permitted to move from outside her house.” She alleged that two cars blocked her vehicle, with policemen standing outside the car doors, and that she was wrongfully confined and restrained, facing a threat to her life and liberty. She also referred to a video of the incident that the court could view.
Allegations Untested
The allegations in the application were those of the applicant and were not tested, and the police personnel concerned have not been reported to have responded to them.
