A Patna court granted bail to Roshan Anand in the Khan Sir coaching institute vandalism case. After release, he alleged Faisal Khan’s involvement in his brother’s death and demanded a narco test during the ongoing controversy.

A Patna court granted bail to Roshan Anand, who was arrested in connection with the alleged vandalism and stone-pelting incident at the coaching institute of educator Faisal Khan, popularly known as Khan Sir, in Bihar.

The case relates to an incident earlier this month involving Khan Global Coaching Institute, located in Patna, where the premises were allegedly damaged and stones were reportedly thrown during a confrontation.

After his release from custody, Roshan Anand made allegations against Faisal Khan and claimed that Khan Sir was responsible for the death of his brother. He demanded that a narco analysis test be conducted on Faisal Khan, stating that such an examination would reveal the facts behind the controversy.

Speaking after his release, Roshan alleged that the police investigation was biased and claimed that Khan Sir was receiving political protection.

He stated:

“Patna police have been compromised and are acting under the influence of Faisal Khan. I was arrested within six hours, but despite having 72 hours, police failed to arrest Faisal Khan. He is enjoying political protection. A narco test should be conducted on Faisal Khan to uncover the truth,”

Roshan further alleged that the case was based on false claims and accused Khan Sir of misleading investigators regarding the incident.

He added:

“This is a conspiracy. Faisal Khan has lied so much. There was no firing from our side, yet he claimed there was. The CCTV footage showed who did the firing. Faisal Khan. Yet, Faisal Khan is out of jail. He has not been arrested by the police,”

Advocate Niranjan Kumar Singh, appearing for Roshan Anand, told that the allegations against his client were false and politically motivated.

Following the bail order, Singh argued that the invocation of Section 109 of the Bharatiya Nyaya Sanhita (BNS), relating to attempt to murder, was improper as the necessary ingredients of the offence were absent.

He stated:

“Section 109 of the BNS (attempt to murder) was wrongfully applied because the case lacked the legally required elements of intention, knowledge and presence of the accused at the crime scene,”

The lawyer alleged that Faisal Khan had used his influence to damage Roshan Anand’s reputation and standing.

According to Singh, there was no sufficient evidence linking Roshan to the alleged offences and he was sent to jail based on what he described as a false version of events.

He further claimed:

“Despite the lack of evidence, Roshan Anand was sent to jail based on a conspiracy and a false statement by Khan sir claiming eight to 10 rounds of gunfire were heard,”

Roshan’s counsel also alleged that Khan Sir was facing serious allegations under the Arms Act in a counter-FIR but managed to obtain interim protection by allegedly withholding important facts and changing his version of events.

The defence claimed that the investigation should have examined all aspects of the incident before attributing criminal liability to Roshan Anand and others.

Factual Backgrounds:

The controversy began after an alleged attack on Khan Global Coaching Institute in Patna earlier this month. According to initial allegations, a group of individuals vandalised the coaching centre and engaged in stone-pelting.

Faisal Khan initially claimed that shots were fired at the institute during the incident, raising concerns about the safety of students and staff present at the premises.

However, police officials later stated that they were unable to independently confirm the firing allegation during the initial stage of investigation.

Khan Sir subsequently stated that the ongoing police probe would establish the exact sequence of events and determine what had occurred.

In connection with the incident, police arrested three persons, including Roshan Anand, who is associated with a rival coaching institute.

The case involves allegations relating to vandalism, violence and other criminal offences, with both sides presenting conflicting versions of the incident.

While the defence has maintained that Roshan Anand was falsely implicated, investigators are continuing to examine available evidence, including CCTV footage and statements of witnesses, to determine the facts.

The grant of bail does not amount to a final determination of guilt, and the allegations raised by both sides remain subject to investigation and further judicial proceedings.
