A court in Delhi has asked bar bodies to take appropriate action after an advocate “unnecessarily provoked” and tried to hit the defence lawyer during trial proceedings.

Advocate Attempts to Hit Defense Lawyer | Court Urges Bar Bodies to Take Action

NEW DELHI: During a trial proceeding under the Protection of Women from Domestic Violence Act, a court in Rohini, Delhi, witnessed an unprofessional incident involving two advocates. The Metropolitan Magistrate, Renu, presiding over the case, had to address inappropriate behavior when one advocate, Anuj Aggarwal, representing the petitioner Swati Tyagi, disrupted the court proceedings.

According to Magistrate Renu’s observations, while the defense lawyer, Vaibhav Nijhawa, was presenting his arguments, Aggarwal repeatedly interrupted him, despite several warnings from the court. The situation escalated when Aggarwal attempted to physically assault Nijhawa and also pushed co-counsel Divya Tripathi and Simran Bati.

In response to these disruptions, Magistrate Renu decided to adjourn the matter and referred the case to the local bar associations for further action. Specifically, the court ordered that a copy of the incident report be sent to the Rohini Court Bar Association and the Bar Council of Delhi, requesting that they take appropriate measures.

A follow-up report is expected by the next hearing date, August 22.

Sanjeev Nasiar, vice-chairman of the Bar Council of Delhi, explained the typical response to such incidents. The council plans to summon both parties involved to conduct a thorough inquiry. Depending on the outcome, the Bar Council of Delhi may impose severe sanctions if professional misconduct is confirmed.

Potential disciplinary actions include suspension of the advocate’s license or enrollment, or at least a stern warning, based on the specifics of the incident.
