New Delhi: Condemning the detention of several lawyers and the alleged excessive and disproportionate use of force by police during the protest held on October 10 against Chief Election Commissioner Gyanesh Kumar and the Special Intensive Revision (SIR) process, the Delhi High Court Bar Association (DHCBA) has called for an impartial inquiry [Resolution of the Delhi High Court Bar Association, October 10, 2026].

DHCBA President and Senior Advocate N Hariharan and Honorary Secretary Vikram Singh Panwar have signed the resolution.

What the Association is asking for

The DHCBA urged an impartial inquiry into the incidents, fixing of responsibility for the alleged excessive force, and appropriate action against those found responsible. It also voiced concern over incidents, as alleged in the resolution, of police personnel tearing the Preamble of the Constitution. These are the Bar Association’s allegations and demands. The response of the Delhi Police to the resolution is not stated in the material available, and no finding has been made on the alleged incidents.

The footage and the principle

The Bar Association expressed strong disapproval of what it described as the excessive and disproportionate use of force against protesting lawyers, women advocates among them. It pointed to video footage that, according to the resolution, showed lawyers, including Senior Advocates, being physically dragged by police.

The DHCBA stated that public order cannot justify arbitrary detention or excessive force against peaceful protesters, and that:

“The right to peacefully assemble and express dissent is a fundamental constitutional guarantee.”

Where this fits

With this resolution, the Delhi High Court’s principal Bar body joins the Supreme Court Bar Association and other lawyers’ bodies that have raised concerns over the treatment of advocates during the protest. It frames the issue as the constitutional right to assemble peacefully and dissent, and asks for accountability through an impartial inquiry. It states the Bar Association’s position and is not a judicial finding, and the contentions of the authorities on the restrictions and the detentions remain to be heard.
