In Madhya Pradesh High Court at Gwalior, a divorce case took an unusual turn when a woman claimed her husband’s sister was his ‘second wife’ to secure a decree. The husband has challenged the ex parte order.

Couples who approach the court for divorce often face allegations such as domestic violence, dowry harassment, or persistent marital conflict.

But a case from Madhya Pradesh took an unusual turn: a woman reportedly pointed to her own husband’s sister as his second wife in order to secure a divorce.

The matter was heard by the Gwalior bench of the Madhya Pradesh High Court, where the husband challenged a one-sided divorce decree.

He claimed the decision was based on what he says was misleading evidence presented by his wife.

As per the case details, the woman residing in Gwalior married in 1998 to a man working with a marketing company. Over time, frequent absences by the husband led to disputes between the couple. By 2015, the woman began living separately.

Although the woman sought a divorce, the husband opposed it. In 2021, she approached the family court and alleged that her husband had remarried. As proof, she submitted a family group photograph showing her husband standing alongside his sister and other relatives.

She claimed that the woman standing next to her husband in the photograph was his second wife. On the basis of this photograph, the family court accepted her version.

Relying on her account, the family court granted her a one-sided divorce order. The husband, according to his challenge, was not given a chance to present his side, and the decree was passed without his participation.

The dispute surfaced when the husband learned of the divorce in the first week of April. After checking court records, he said he was shocked to find that the photograph used as evidence appeared to show his second wife but that person was, in fact, his sister.

Government advocate Dharmendra Sharma said that the husband has now challenged the one-sided divorce order before the Madhya Pradesh High Court’s Gwalior bench.

The husband has alleged that his wife misled the court and obtained the divorce decree through false representation.

The High Court is currently hearing the case, with the husband requesting that the divorce order be set aside. He argues that the ruling was based on misleading and incorrect claims.
