Unnao Custodial Death Case| Surrender: Delhi High Court Orders Kuldeep Sengar’s Brother Jaideep

The Delhi High Court directed Jaideep Sengar, brother of Unnao rape convict Kuldeep Sengar, to surrender before jail authorities after upholding his conviction in the custodial death case linked to the survivor’s father,

The Delhi High Court ordered Jaideep Sengar, brother of Unnao rape case convict Kuldeep Sengar, to surrender to jail authorities due to his conviction in the custodial death case involving the survivor’s father.

A bench comprising Justices Navin Chawla and Ravinder Dudeja was considering Jaideep Sengar’s plea for an extension of interim bail following the suspension of his 10-year sentence.

The court noted that Jaideep had been granted interim bail in July 2024, which lasted until April 2025, but since then, there had been no further orders for extension or suspension despite five subsequent court dates.

When Jaideep Sengar’s senior counsel requested an extension of his bail based on health issues, the bench responded,

“You surrender and then we will see.”

The bench emphasized,

“Although there is no extension of interim suspension of sentence granted, we find he has still not surrendered. Before we proceed to consider his application for further extension of suspension of sentence, we require the appellant to first surrender.”

The senior counsel assured the court that Jaideep would surrender by Saturday.

The court scheduled the matter for a hearing next week.

Jaideep Sengar, 50, requested the bail extension on the grounds of suffering from oral cancer. The Central Bureau of Investigation’s counsel had previously stated that it was not an appropriate case for extending interim bail, claiming the medical documents provided by Jaideep were fabricated.

In his application, Jaideep mentioned he was diagnosed with stage IV oral cancer, a serious condition that had shown signs of recurrence and required ongoing specialized medical care. He also noted that he had spent approximately four years in custody.

The high court had initially granted him interim bail on July 3, 2024, for two months on medical grounds.

Kuldeep Sengar had been sentenced to life imprisonment on December 20, 2019, for raping a minor in 2017. On March 13, 2020, both Kuldeep and Jaideep Sengar received 10 years’ rigorous imprisonment from the trial court, along with a fine of Rs.10 lakh, in relation to the custodial death of the rape survivor’s father.

The survivor’s father was arrested reportedly at the insistence of the accused under the Arms Act and died in custody on April 9, 2018, due to police brutality. The trial court stated that no leniency could be shown for the killing of a family’s sole breadwinner.

Kuldeep Singh Sengar, a former BJP MLA from Unnao, was convicted in 2019 for raping a minor who had approached him in 2017 seeking help for employment. He was sentenced to life imprisonment.

The case drew nationwide attention due to allegations of abuse of power, custodial lapses, and subsequent incidents, including a car crash in 2019 that killed two of the survivor’s relatives. Kuldeep Sengar’s sentence was suspended by the Delhi High Court because he had already served over seven years in prison, pending appeal.
