Today, On 18th February, The Delhi High Court scheduled a hearing for March 6 on a plea by expelled BJP leader Kuldeep Sengar. He is challenging his 10-year prison sentence in the custodial death case of the Unnao rape survivor’s father. Sengar was convicted for his role in the case, which created nationwide outrage. The court will review his appeal and decide on the matter.

New Delhi: The Delhi High Court scheduled a hearing for March 6 regarding the plea of expelled BJP leader Kuldeep Sengar, who is appealing his 10-year prison sentence in the custodial death case involving the father of a rape survivor from Unnao.
Justice Vikas Mahajan granted the request from the CBI counsel to adjourn the matter, which Sengar’s legal team did not oppose.
Sengar’s counsel indicated that they were preparing a note on submissions for the suspension of the sentence, in addition to the main appeal against the trial court’s ruling.
Sengar has received interim bail multiple times on medical grounds related to both the Unnao rape case and the custodial death case. He was convicted of raping a minor survivor and sentenced to life imprisonment on December 20, 2019.
The incident occurred in 2017, when the girl was allegedly kidnapped and raped by Sengar. His appeal against the trial court’s verdict in the rape case is currently pending in the high court, where he seeks to quash the December 16, 2019 judgment that convicted him and to set-aside the sentencing order.
On March 13, 2020, the trial court sentenced Sengar to 10 years of rigorous imprisonment in the custodial death case and imposed a fine of Rs 10 lakh, stating that “no leniency” could be shown for the killing of a family’s “sole breadwinner.”
The girl’s father had been arrested at Sengar’s alleged behest under the Arms Act and died in custody on April 9, 2018, due to police brutality.

The case pertains to the kidnapping and rape of a minor girl by Sengar in 2017.
Additionally, on March 13, 2020, the trial court sentenced Sengar to 10 years of rigorous imprisonment, along with a fine of Rs. 10 lakh, in the case related to the death of the rape victim’s father while in custody. The trial court emphasized that no leniency could be shown, given that the victim’s father was the sole breadwinner of the family.
In addition to Kuldeep Singh Sengar’s conviction, the trial court also awarded 10 years of imprisonment to Sengar’s brother, Atul Singh Sengar, and five other individuals for their role in the custodial killing of the rape victim’s father.
The rape victim’s father arrested on the orders of Sengar under the Arms Act. He subsequently died in custody on April 9, 2018, due to police brutality. Although the trial court did not find the accused guilty of murder under the Indian Penal Code (IPC), it awarded the maximum sentence for the offense of culpable homicide not amounting to murder, under Section 304 of the IPC. The court noted that, no intention to kill on the part of the accused.
The case originally being heard in a trial court in Uttar Pradesh but later transferred to Delhi, on the directions of the Supreme Court, on August 1, 2019.
