Unnao rape case convict Kuldeep Singh Sengar, serving a life sentence, Today (Jan 27) returned to Tihar Jail as his scheduled cataract surgery at AIIMS was delayed due to the doctor’s unavailability. The Delhi High Court had granted him interim bail on medical grounds, directing his surrender by January 27 if the surgery didn’t occur. His appeal against the 2019 verdict and other legal matters, including a custodial death case, are pending in court.

NEW DELHI: Kuldeep Singh Sengar, a convict in the Unnao rape case, was recently granted temporary bail for medical reasons but has returned to Tihar Jail as his scheduled surgery could not take place. His lawyer informed the Delhi High Court about the situation on Monday.
A bench of Justices Yashwant Varma and Harish Vaidyanathan Shankar learned that Sengar surrendered and went back to jail on January 24. This was because the AIIMS doctor who was supposed to perform his eye surgery was unavailable until January 30.
Sengar, who is serving a life sentence for the case, plans to approach the court again on either January 28 or 29 to seek fresh medical bail for his cataract operation.
The court instructed Sengar’s counsel to begin arguments on his appeal related to the Protection of Children from Sexual Offences (POCSO) Act case in February. On January 22, the court had granted him temporary bail for medical reasons.
The bench made it clear that Sengar must surrender no later than January 27 after being discharged from the hospital. It also stated that if the surgery did not happen on January 24, he should return to jail that same evening.
Sengar is also imprisoned in connection with the custodial death of the survivor’s father. His petition to suspend the 10-year sentence in that case is still under consideration by another bench.
Previously, Sengar had been granted two weeks of interim bail in December 2024 due to health issues. This bail was later extended by one more month. However, on January 20, the high court declined to extend it further and directed him to surrender, noting that the application for bail extension had not been shared with the survivor.
Sengar’s lawyer requested a 30-day interim bail, stating that he had been advised to undergo cataract surgery at AIIMS and was supposed to be admitted on January 24. The Central Bureau of Investigation (CBI) confirmed this claim.
However, the survivor’s lawyer opposed the request, arguing that Sengar should not receive endless interim bail and raising concerns about the safety of the survivor and her family, who have reportedly faced threats from the convict.
While granting Sengar temporary relief, the court mentioned that there were no current allegations of him violating any conditions of his previous bail.
Sengar’s request for an extension of his interim bail is part of his appeal against the December 2019 trial court verdict, which convicted him of raping a minor girl. He has also requested that the verdict be overturned.
The case dates back to 2017 when Sengar, who was later expelled from the BJP, allegedly kidnapped and raped a minor girl. In 2019, the Supreme Court transferred the rape case and related cases from a trial court in Uttar Pradesh to Delhi for impartial proceedings.
