Delhi High Court Bars Priya Kapur From Dealing With Sunjay Kapur’s Assets In Plea By Karisma Kapoor’s Children

Justice Jyoti Singh said Sunjay Kapur’s estate must be preserved until the genuineness of the disputed Will is decided at trial.

New Delhi: The Delhi High Court has barred Priya Kapur from dealing with or dissipating several assets left behind by late industrialist Sunjay Kapur in a plea moved by Bollywood actor Karisma Kapoor’s two children.

Justice Jyoti Singh, while pronouncing the order orally, observed that the assets forming part of Sunjay Kapur’s estate must be preserved and should not be dissipated till the dispute over the genuineness of his Will is finally decided.

The Court noted that both Karisma Kapoor’s children and Sunjay Kapur’s mother have raised doubts over the validity and authenticity of the Will. The Court held that once such suspicions have been raised, it would be for Priya Kapur to dispel them during trial.

Justice Singh clarified that the question of whether the Will is genuine or not will be decided at trial. However, until that happens, the estate of the testator, Sunjay Kapur, must be protected.

The Court has restrained Priya Kapur from alienating, transferring, pledging, or altering the equity and shareholding of Indian companies forming part of Sunjay Kapur’s estate.

The Court also recorded that Priya Kapur has been barred from withdrawing the provident fund amount, something she had agreed to. She has also been restrained, by consent, from dealing with personal assets such as artwork and other personal effects.

Justice Singh further ordered that Priya Kapur will remain restrained from withdrawing money from three bank accounts maintained in two Indian banks, except to the limited extent required to meet liabilities towards the children as stipulated under the divorce decree between Sunjay Kapur and Karisma Kapoor.

The Court also barred the operation of foreign bank accounts and cryptocurrencies held by Sunjay Kapur.

However, the High Court clarified that its interim order will not apply to immovable properties held by Sunjay Kapur outside India.

Background Of The Dispute

The dispute relates to the estate of late industrialist Sunjay Kapur, former chairman and non-executive director of Sona BLW Precision Forgings Ltd, also known as Sona Comstar. Sunjay Kapur died on June 12, 2025, after suffering a heart attack in England while playing polo. He was 53.

After his death, Karisma Kapoor’s two children approached the Delhi High Court claiming rights in their late father’s estate. They challenged the alleged Will and sought protection of the estate pending adjudication of the dispute.

The Will in question is stated to be dated March 21, 2025. Earlier reports noted that the children challenged its authenticity and alleged that it excluded them from their father’s personal estate. The Delhi High Court had earlier asked Priya Kapur to disclose details of Sunjay Kapur’s assets in the proceedings.

Sunjay Kapur’s mother, Rani Kapur, has also raised objections in relation to the Will and the handling of family assets. The challenge to the Will is now a central issue in the Delhi High Court proceedings.

Earlier this year, the High Court also permitted forensic and handwriting inspection of the original Will after doubts were raised over its authenticity. The inspection was allowed with the assistance of forensic and handwriting experts. This made the genuineness of the Will one of the most important issues in the inheritance dispute.

The family is also involved in a separate dispute concerning the RK Family Trust. Recently, the Supreme Court issued notice in proceedings initiated by Rani Kapur and also suggested mediation in the family dispute.

Today’s interim order is significant because the Court has protected the estate from being altered or dissipated while the trial on the validity of the Will remains pending.
