Bombay High Court Defers Form 8 Rejection Challenge To October 13, ECI Cites Supreme Court

Panaji: The Bombay High Court at Goa has put off to October 13, 2026 a petition against the rejection of Form 8 applications during the Special Intensive Revision (SIR) of electoral rolls. The one-week adjournment was sought by the Election Commission of India, which pointed to related matters pending in the Supreme Court [Paresh Salgaonkar v. State of Goa].

The Bench of Justice Valmiki Menezes and Justice Amit Jamsandekar heard the matter. The petitioners, Paresh Salgaonkar and family from the St Cruz Assembly constituency, challenge the deletion of their names from the electoral roll.

What the judges said

The Bench indicated that Supreme Court orders might not bear directly on the Goa petition, yet it allowed the adjournment for a week pending any ruling from the Supreme Court. The Court has made no finding on the merits of the petition.

Why the Commission wanted time

Advocate Gaurish Agni, appearing for the Election Commission, submitted that the Supreme Court had issued directions in some SIR petitions and that a petition presented before a High Court should ideally have its hearing deferred. In his submission, the Sikkim, Uttarakhand and Kerala High Courts had passed similar orders deferring hearings, the Supreme Court was expected to hear related petitions on October 8, and the Form 8 rejection could not be examined in isolation from the preceding processes.
