The Delhi High Court dismissed an assault case filed by Samir Modi against his mother Bina Modi, advocate Lalit Bhasin and security guard Surendra Prasad. The court found no grounds to continue proceedings.
The Delhi High Court dismissed the assault case brought by former Executive Director of Godfrey Phillips India, Samir Modi, against his mother Bina Modi, advocate Lalit Bhasin, and Bina Modi’s personal security guard, Surendra Prasad.
Justice Saurabh Banerjee issued the order after learning that the issues between the parties have been resolved and that Samir Modi has withdrawn his complaint.
During the hearing conducted via video conferencing, Samir Modi informed the court that he had withdrawn the case. Bina Modi also participated in the proceedings through virtual mode.
The court observed that the compromise arrangement lacked key details, noting that there was no settlement agreement and that no specific amount was stated as the basis for the resolution.
Justice Saurabh Banerjee asked,
“No amount is mentioned. There is no settlement deed. Mr Modi you are the complainant. Have you compromised?”
In his original complaint, Samir Modi had alleged that his right index finger was broken and that he required surgery involving the placement of a screw and wire.
The medico-legal certificate described the injury as grievous. The court record also indicated that CCTV footage of the incident was collected.
Samir Modi further claimed that when he told Bina Modi about the assault, she instructed him to sit down and allow the meeting to continue, and that Bhasin urged the meeting to proceed despite his injuries.
Earlier, Bina Modi, Lalit Bhasin, and Surendra Prasad had moved the High Court challenging the trial court proceedings. The High Court had stayed the proceedings in March.
