Supreme Court Transfers Hit-and-Run Case Involving Judicial Officer from Punjab to Delhi for Fair Trial

The Supreme Court has moved a hit-and-run case against a probationary judicial officer from Punjab to a Delhi court after the victim’s family alleged bias. The Bench also directed that any further probe be handled by the Delhi Police.

New Delhi: The Supreme Court of India on Thursday ordered the transfer of a hit-and-run case involving a probationary judicial officer from Punjab to the Rohini trial court in Delhi.

A Bench of Justices Surya Kant and Joymalya Bagchi made this decision after the family of the deceased raised concerns about possible bias in the ongoing trial, as the accused in the case is a judicial officer himself.

The family had requested that the case be moved outside Punjab to ensure a fair and impartial trial.

During the hearing, the counsel representing the accused judicial officer informed the Supreme Court that

“he has no objection if the trial is transferred to a court in Delhi from Punjab”,

but he also suggested that it would be better for him

“if the trial is transferred to Noida in Uttar Pradesh”, since the “victim’s sister-in-law was a practising advocate in Delhi.”

After hearing both sides, the Supreme Court decided to transfer the case to a court of the Additional Chief Metropolitan Magistrate in Delhi.

Along with this, the Bench also transferred another connected case in which the victim’s wife had requested that the investigation be moved from the Punjab Police to the Central Bureau of Investigation (CBI).

The court said,

“If there is need for any further investigation in the case, it shall be done by the Delhi Police.”

In addition to this, the Supreme Court also ordered the transfer of a Motor Accident Claims Tribunal (MACT) case related to the same incident from Kullu, Himachal Pradesh, to a court in Delhi.

According to the complaint filed by the deceased’s wife, her husband had died in a hit-and-run accident in February this year.

The accident allegedly involved a car belonging to the judicial officer, who was posted as a probationary officer in Hoshiarpur district of Punjab at the time.

The apex court was informed that the case was still at the stage of framing of charges before the Judicial Magistrate Court in Phagwara when the transfer request was made.

The Supreme Court’s decision aims to ensure transparency, fairness, and public confidence in the judicial process, especially in a case where one of the accused is part of the judicial system itself.
