The Bombay High Court held that factual findings of a Motor Accidents Claims Tribunal cannot be challenged through certiorari merely alleging insufficient evidence. Reappreciation of evidence lies outside writ jurisdiction, which must operate within strict limits under Article 226.
The Supreme Court has moved a hit-and-run case against a probationary judicial officer from Punjab to a Delhi court after the victim’s family alleged bias. The Bench also directed that any further probe be handled by the Delhi Police.
The Bombay High Court upheld Rs. 62 lakh compensation to the family of an SRK production house employee who died after a hit-and-run, stating, “Fair compensation ought to be the norm, though perfect compensation is hardly possible.”
