New Delhi: Today, on June 20, the Supreme Court of India has directed the Delhi High Court to make a decision within two weeks regarding the bail application of Kapil Wadhawan, former promoter of Dewan Housing Finance Corporation Limited (DHFL).

He has been in jail since July 2022 in connection with a major bank fraud case being investigated by the Central Bureau of Investigation (CBI).

A bench comprising Justices Ujjal Bhuyan and Manmohan was hearing the matter and noted that Wadhawan has already been in custody for almost two years.

The bench was informed that his bail plea is scheduled to be heard on July 18 by the Delhi High Court.

Taking this into account, the Supreme Court ordered the high court to take up the matter seriously and decide on the bail plea

“within two weeks from the date of hearing.”

The case involves a multi-crore banking scam in which Kapil Wadhawan is a key accused.

The CBI has been probing financial irregularities and fraud involving public sector banks and DHFL, where large sums of money were allegedly misused or siphoned off through shell companies and fake transactions.

Wadhawan’s legal team approached the Supreme Court seeking intervention as there had been repeated delays in deciding his bail plea.

The top court, without getting into the merits of the case, focused on the prolonged duration of custody and the need for timely judicial decisions in bail matters.

The bench highlighted that the liberty of an undertrial is an important constitutional concern and should not be delayed unnecessarily.

Therefore, it issued a clear directive to the Delhi High Court, stating:

“Wadhawan was in custody since July, 2022 and his bail plea was coming up for hearing on July 18 in the high court.”

The court further ordered:

“The high court shall decide the bail plea within two weeks from the date of hearing.”
