Molestation Case| Mumbai Court Summons Prithvi Shaw

Today, On 30th April, a Mumbai court summoned Prithvi Shaw, a prominent Indian cricketer. The court’s action follows allegations related to the case, marking a legal development in the ongoing investigation. Shaw’s summons indicates a significant legal step in addressing the accusations against him. The case is expected to progress further as legal proceedings unfold.

Mumbai: A sessions court, On Tuesday, issued a summons to Prithvi Shaw in response to a petition filed by social media influencer Sapna Gill. This petition contested the decisions made by a magistrate regarding her complaint against the cricketer.

Earlier this month, a metropolitan court in Andheri instructed the police to conduct an investigation into Gill’s plea, which requested the filing of a First Information Report (FIR) against Shaw. The basis for this request Gill’s allegation that Shaw molested her at a pub.

Despite this, the metropolitan court rejected another plea from Gill, which sought action against the police for not registering a case based on her complaint against Shaw and his friend. Displeased with both rulings, Sapna Gill filed a review application before a sessions court in Malad. This step indicates her dissatisfaction with the legal decisions made so far and her persistence in seeking legal redress regarding her complaints against Shaw and his friend.

Gill’s review application, filed by advocate Ali Kaashif Khan, argues that the order passed by the metropolitan magistrate on April 3 is irregular and illegal, with the court making a “grave error” in its decision.

On Tuesday, additional sessions judge D G Dhoble summoned Shaw in response to the application. The court also summoned the airport police, who initially did not register a case when Gill first approached them.

The next hearing on this matter is scheduled for June 6.

In a separate incident, Gill arrested in February 2023 along with others for allegedly attacking Shaw following a disagreement over taking selfies at a suburban hotel. After securing bail in her case, Gill approached the Andheri airport police station with a molestation complaint against Shaw, his friend Ashish Yadav, and others.

When the police didn’t take action on her complaint, she then went to the magistrate court to seek redress.

In her complaint, Gill requested the filing of an FIR under Indian Penal Code sections 354 (molestation), 509 (gesture or act intended to insult a woman’s modesty), and 324 (causing hurt by dangerous means) against Shaw and Yadav. She alleged that they assaulted her with a bat.

This sequence of events highlights Gill’s efforts to seek legal recourse after her initial complaint not acted upon by the police. The specific sections of the Indian Penal Code cited in her complaint indicate the nature of the allegations and the seriousness with which she views the incident.

This case attracted significant media attention due to the involvement of a public figure and the serious nature of the allegations. The court waiting for further evidence and scheduled another hearing to review additional materials including video footage provided by Gill’s legal team.​

This legal battle has highlighted significant issues regarding the handling of molestation claims, the responsibilities of law enforcement, and the complexities of high-profile cases involving public figures.
