The Bar Council of Uttar Pradesh has souaght a high-level inquiry into alleged police misbehaviour with lawyers in Banaras. It warned of a statewide protest if the Advocate Protection Act is not implemented immediately.

The Bar Council of Uttar Pradesh has raised strong objections against the recent incidents of alleged police misconduct with lawyers in Banaras. In a letter dated September 18, 2025, the Council has demanded that the Uttar Pradesh government order a high-level magisterial inquiry into the matter.

The letter was written by Paresh Mishra, Member and Former Chairman of the Bar Council of Uttar Pradesh, and addressed to Chief Minister of the state.

Mishra has called for immediate steps to protect advocates, including the implementation of the long-pending Advocate Protection Act. He also warned that lawyers across the state are ready to launch a massive agitation if the demands are ignored.

Condemning the alleged actions of the police, the Council described them as

“extremely serious, condemnable, and contrary to the dignity of the justice system.”

The representation further said that the repeated behaviour of police officials amounts to

“a direct attack on the freedom and respect of advocates,”

who play a key role in ensuring that justice is delivered in society.

The Bar Council pointed out that such incidents are not new and cited earlier cases in Prayagraj and Hapur where lawyers were allegedly assaulted, harassed, and misbehaved with by police officers.

According to the letter, these incidents have created

“a deepening sense of insecurity and anger”

among advocates throughout Uttar Pradesh.

In its letter to the government, the Bar Council listed five clear demands.

These include:

  1. A high-level magisterial inquiry into the Banaras incident.
  2. Strict punitive action against all police officers and personnel found guilty.
  3. Concrete measures to ensure the dignity, safety, and respect of advocates.
  4. Immediate enactment of the Advocate Protection Act in Uttar Pradesh to guarantee legal protection for lawyers.
  5. Clear and strict guidelines to prevent similar incidents in the future.

The letter ended with a firm warning to the government, making the Council’s stand clear.

It stated,

“If immediate and concrete action is not taken on these demands, the entire advocate community will be forced to launch a major statewide agitation.”

The Council urged the Chief Minister to act quickly and sensitively in this matter. At the same time, it underlined that the legal community is united and prepared for a large-scale protest if their rights, dignity, and security are not safeguarded.
