Breaking: Senior Advocate Appeals to CJI BR Gavai to Reconsider Transfers of Justices Arun Monga & Tara Vitasta Ganju from Delhi High Court

Senior Advocate Vikas Pahwa has appealed to CJI BR Gavai to halt the proposed transfers of Justices Arun Monga and Tara Vitasta Ganju, citing their outstanding contributions at Delhi High Court. He emphasized that their relocation could impact timely justice delivery and public confidence in the judiciary.

New Delhi: On 27 August, senior Advocate Vikas Pahwa has formally written to Hon’ble Chief Justice of India, Mr. Justice Bhushan Ramkrishna Gavai, urging reconsideration of the proposed transfer of two sitting judges of the Delhi High Court.

The proposed transfers involve Hon’ble Mr. Justice Arun Monga, slated to move to the Rajasthan High Court, and Hon’ble Ms. Justice Tara Vitasta Ganju, proposed to be transferred to the Karnataka High Court.

In his letter dated 27 August 2025, Mr. Pahwa highlighted the significant impact both judges have made during their tenure at the Delhi High Court.

Referring to Justice Arun Monga, he stated:

“Justice Arun Monga, in his brief tenure at the Delhi High Court since 21.07.2025, has left a profound impression on both the Bar and litigants. His judicial acumen, deep knowledge of criminal law, and commitment to upholding liberty have translated into swift and effective disposal of matters. Bail applications are now being decided promptly and with clarity. His approach has not only reduced pendency but has also instilled renewed confidence in the criminal justice system. For the litigants, his presence in the Court has meant timely access to justice; for the criminal Bar, his work has been a breath of fresh air. His transfer at this stage would be a significant loss to both.”

Mr. Pahwa also emphasized the contribution of Justice Tara Vitasta Ganju, noting her fairness, integrity, and strong command over civil jurisprudence and procedural law.

He added:

“Justice Tara Vitasta Ganju has, with equal commitment, earned respect for her fairness, integrity, and strong command over civil jurisprudence and procedural law. She has demonstrated balance, patience, and dedication in her judicial work, inspiring faith among lawyers and litigants alike.”

The senior advocate expressed concern that unverified reports, unrelated to the judges’ official duties or judicial performance, may have influenced the proposed transfers.

He cautioned:

“While transfers undoubtedly fall within the administrative discretion of the Collegium, such actions, when not grounded in judicial performance, risk unsettling not only the Judges concerned but also the morale of the institution as a whole. Judicial independence and continuity must not only be preserved but must also be seen to be preserved in the eyes of the public and the Bar.”

Highlighting Justice Monga’s swift establishment of credibility in the legal community, Mr. Pahwa remarked:

“Justice Monga, in particular, has very quickly earned the confidence of the legal fraternity through his reasoned, liberty-oriented approach and efficient case management. His retention at the Delhi High Court would greatly serve the cause of justice and reinforce the perception of judicial stability, efficiency, and independence.” He further stressed the importance of retaining Justice Tara Ganju: “Likewise, retaining Justice Tara Ganju would ensure continuity and strengthen confidence in the fairness of the system.”

Concluding his plea, Mr. Pahwa urged the Chief Justice of India to reconsider the transfers, stating:

“For these reasons, I most respectfully urge Your Lordship to kindly reconsider the proposed transfers in the larger interest of justice, litigant confidence, and judicial continuity.”
