NEW DELHI: Senior Bharatiya Janata Party (BJP) leader Amit Malviya made an attack on Congress MP Priyanka Gandhi Vadra on Wednesday, accusing the Gandhi family of displaying “smug entitlement” and challenging the authority of the judiciary.

His comments came after Priyanka Gandhi criticized the Supreme Court for its recent observations against her brother, Rahul Gandhi, over remarks concerning the Indian Army.

In a post on X (formerly Twitter), Malviya said:

“If the Courts won’t decide who is national and who is anti-national, then who will? The smug entitlement of the Gandhi family is not just baffling—it reeks of contempt for the judiciary.”

He further warned that Priyanka Gandhi’s statement amounted to a direct challenge to the Supreme Court’s authority and called for suo motu action, similar to the one taken against BJP MP Nishikant Dubey for his remarks against the judiciary.

“The law must apply equally to all. The Gandhis cannot be allowed to believe they are above it,”

Background

The Supreme Court on Monday stayed proceedings against Rahul Gandhi in a Lucknow court regarding his alleged comments on the Indian Army during the Bharat Jodo Yatra in December 2022. However, the apex court strongly censured him, stating:

“If you are a true Indian, you won’t say such a thing. Why do you make these statements without any material? You are the Leader of Opposition—why not raise issues in Parliament instead of social media?”

This criticism sparked strong reactions from the Congress party and the INDIA bloc, which termed the court’s observations “unwarranted” and an infringement on democratic rights.

Supporting her brother, Priyanka Gandhi questioned the judiciary’s role in defining nationalism, saying:

“With due respect to the honourable judges of the Supreme Court, they do not decide who is a true Indian. It is the job of the opposition leader. It is his duty to ask questions and to challenge the government.”

Her remarks drew sharp criticism from the BJP, with Amit Malviya leading the charge.

While the Congress defended Rahul Gandhi’s remarks as part of his responsibility as Leader of Opposition, BJP leaders lashed out, branding him the “China guru” and alleging that he and his party harbor hatred toward the Indian Armed Forces.

Parliamentary Affairs Minister Kiren Rijiju expressed hope that Rahul Gandhi would mend his ways after being “rebuked” by the Supreme Court for making unsubstantiated claims.

The BJP on Wednesday announced plans to file a contempt of court petition against Congress MP Priyanka Gandhi Vadra over her criticism of the Supreme Court’s remarks against her brother Rahul Gandhi for his alleged comments on the Indian Army.

BJP leader Amit Malviya accused the Gandhis of “smug entitlement” and said their defiance “reeks of contempt for the judiciary.” BJP MP Manan Kumar Mishra stated that Priyanka’s statements showed “irresponsibility” and confirmed lawyers would move the petition. He said,

“She (Ms Vadra) has committed contempt of court by making so many statements before the media. Therefore, we are going to file a contempt petition against her because she has been making such irresponsible statements without knowing what the court intended to say (to Rahul Gandhi). The petition will be filed by the bar and the lawyers. The public of this country will not tolerate such irresponsible statements…”

The move follows the Supreme Court’s censure of Rahul Gandhi for his remarks during the Bharat Jodo Yatra, questioning why such statements were made without evidence. Priyanka had responded that judges cannot decide who is a “true Indian,” asserting it is the opposition’s duty to question the government.

The BJP has demanded equal application of the law, calling Priyanka’s remarks a direct challenge to the court’s authority.
