Stall The Impeachment Proceedings: AIBA Urges President Not to Accept Justice Verma’s Resignation

AIBA has urged President Droupadi Murmu to carefully review Justice Yashwant Varma’s resignation during ongoing impeachment proceedings. It warned that accepting the resignation now could weaken accountability and disrupt the constitutional process.

The All India Bar Association (AIBA) has written to Droupadi Murmu, urging her to carefully think before accepting the resignation of Justice Yashwant Varma. The Association has raised serious concerns that accepting the resignation at this stage could impact the ongoing impeachment process against the judge in Parliament.

In its letter, AIBA Chairman and Senior Advocate Dr Adish C Aggarwala pointed out that earlier, when Justice Sanjiv Khanna had asked Justice Varma to step down, he had chosen to face an inquiry instead of resigning. However, now that impeachment proceedings have already started, his sudden resignation raises important questions about accountability and whether the constitutional process will be completed properly.

The AIBA explained that if the resignation is accepted now, it may make the ongoing impeachment proceedings meaningless. This could prevent a full and transparent examination of the allegations through the proper constitutional mechanism. The Association also highlighted that such a move may weaken the role of Parliament in ensuring judicial accountability.

The letter further stressed that maintaining the dignity, independence, and credibility of the judiciary is extremely important. It said that any issue that affects public trust in the justice system must be handled strictly according to constitutional procedures.

Dr Aggarwala, who is also a former President of the Supreme Court Bar Association and former Vice-Chairman of the Bar Council of India, has requested the President to take a balanced and careful decision so that the constitutional process continues in the larger public interest.

Meanwhile, Justice Yashwant Varma, a judge of the Allahabad High Court, has submitted his resignation to the President of India with immediate effect through a letter dated April 9, 2026. In his resignation letter, he wrote, “with immediate effect”.

He also stated that he did not want to trouble the President’s office by explaining the reasons behind his decision but mentioned that he was stepping down with “deep anguish”. He further added that it had been an honour to serve as a Judge of the High Court of Judicature at Allahabad. A copy of this resignation letter has also been sent to the Chief Justice of India.

This development has now created an important constitutional situation, where the decision of the President will play a key role in determining whether the impeachment process continues or comes to an end.
