DEHRADUN: On 21st February, the Uttarakhand High Court has taken a decisive step. The court, led by Justice Manoj Kumar Tiwari, has issued a landmark order concerning the case of a young girl facing expulsion from Woodstock School, located in the picturesque town of Mussoorie. This decision not only highlights the judiciary’s role in safeguarding children’s rights but also sets a precedent for how schools should address bullying and student grievances.
The court’s intervention came after it was brought to light that the girl, who had been admitted to Woodstock School for the 2022-23 academic year, was subjected to bullying by her peers. Despite her efforts to seek help, the school’s response was far from supportive. Reports indicate that instead of taking measures to address the bullying, the school administration took a drastic step by issuing letters on December 18 and 20, 2023, to the girl’s parents, urging them to withdraw their daughter from the institution.

Recognizing the situation and the potential impact on the student’s mental and emotional well-being, the court ordered a psychiatric evaluation. The evaluation, conducted by a qualified psychiatrist, revealed that while the girl was experiencing stress due to her expulsion, she was otherwise mentally sound. This finding played a crucial role in the court’s decision-making process.
Justice Manoj Kumar Tiwari’s bench made a series of directives aimed at rectifying the situation and ensuring the student’s rights were protected. The court ordered Woodstock School to reinstate the girl as a regular student, allowing her to continue her education and reside in the hostel. This move underscores the judiciary’s commitment to ensuring that educational institutions fulfill their responsibility towards all students, irrespective of the challenges they may face.
Furthermore, the court emphasized the need for a supportive and harassment-free environment. It directed the school’s principal to take necessary measures to ensure that the student is not subjected to harassment or bullying. This directive is a clear message to educational institutions about the importance of creating a safe and nurturing environment for all students.

In addition to the school’s responsibilities, the Dehradun chapter of the Child Welfare Committee (CWC) has been tasked with a crucial role. The court instructed the CWC to maintain regular contact with the student and to make visits to the institution as needed to monitor her well-being. This involvement of the CWC highlights the collaborative effort required to safeguard children’s rights and well-being in educational settings.
The court’s decision also includes a provision for addressing any discrepancies or issues that may arise in the future. It stated that any such matters would be handled by the CWC secretary in accordance with the law. This ensures a mechanism is in place for ongoing oversight and intervention if necessary.
