The Delhi High Court has asked the Central Bureau of Investigation to state its position on Jaideep Sengar’s request for a three-month extension of interim bail. The plea cites stage-IV oral cancer and seeks continued medical relief in the custodial death case of the Unnao rape survivor’s father.

New Delhi: The Delhi High Court on Monday asked the Central Bureau of Investigation (CBI) to respond to a plea filed by Jaideep Sengar, brother of expelled BJP leader Kuldeep Sengar, seeking an extension of his interim bail by three months in the custodial death case of the Unnao rape survivor’s father.

The matter was heard by Justice Swarana Kanta Sharma, who issued notice to the CBI and fixed the next hearing on February 11. Jaideep Sengar’s counsel informed the court that the interim bail granted to him was set to expire on February 11 and requested an extension on medical grounds.

The lawyer submitted that Jaideep Sengar is suffering from oral cancer and is undergoing treatment. It was argued before the court that his medical condition is serious and requires continuous care.

In the application moved before the High Court, Jaideep Sengar stated that he is suffering from stage IV oral cancer, which is a life-threatening illness. The plea further stated that he has developed clinical signs of recurrence, indicating that the disease may have returned.

The plea said that his condition requires continuous and specialised medical care and monitoring. It also informed the court that Jaideep Sengar, aged 50, has already spent nearly four years in custody in connection with the case.

The Delhi High Court had earlier granted interim bail to Jaideep Sengar on July 3, 2024. Since then, the bail has been extended from time to time considering his medical condition.

Kuldeep Sengar, a former BJP MLA, was convicted in the rape case involving a minor girl and was sentenced to imprisonment for the remainder of his life on December 20, 2019.

According to the prosecution, the girl was kidnapped and raped by Kuldeep Sengar in 2017 when she was a minor.

Later, on March 13, 2020, Kuldeep Sengar along with his brother Jaideep Sengar alias Atul Singh was sentenced to 10 years of rigorous imprisonment by the trial court in the custodial death case of the rape survivor’s father. The trial court also imposed a fine of Rs 10 lakh on the accused.

The prosecution case stated that the survivor’s father was arrested under the Arms Act at the alleged behest of the accused. He later died in police custody on April 9, 2018, allegedly due to police brutality.
