Delhi High Court refused to stay trial against accused in alleged assault on Delhi Chief Minister Rekha Gupta. Justice Anup Jairam Bhambhani rejected plea, allowing proceedings, with evidence scheduled to begin April 20.

The Delhi High Court declined to stay the proceedings of a lower court trial against two men accused of assaulting Delhi Chief Minister Rekha Gupta during August last year.
Justice Anup Jairam Bhambhani rejected the stay plea filed by the lawyers for Sakriya Rajeshbhai Khimjibhai and Tahseen Raza. The defence argued that the matter would come up next on April 20, when evidence was expected to begin.
Noting the trial court’s preparedness to move forward, the High Court observed that the lower court had already summoned the medical officer, the examiner who prepared the medico-legal certificate (MLC), and Gupta’s personal security officer (PSO).
After considering the request, the High Court refused to grant any stay.
The Court remarked,
“I do not believe in staying something unless I am very clear that something wrong is going on or will go on. I do not see that [here] at all,”
Justice Bhambhani also asked for an explanation regarding the accused being present at Gupta’s “jan sunwai (public hearing)”, despite not being residents of Delhi.
He said,
“I still do not understand why you were in Delhi at all. Pardon me for saying this, but ordinarily, people who are taxi drivers or auto drivers have to keep working every day. They may not be daily wagers, but they do not give up their work to show up in a State hundreds of kilometres away to participate in a protest,”

The High Court issued notice to the Delhi Police and fixed the case for further hearing on May 21. The matter before the court related to Khimjibhai and Raza’s challenge to the trial court’s order framing charges against them.
According to the case details, the alleged assault on Rekha Gupta took place on August 20, 2025, at her Civil Lines camp office during a public “jan sunwai.” In December 2024, the trial court framed charges including attempt to murder, criminal conspiracy, and assault on a public servant.
After hearing the matter, Justice Bhambhani directed the forensic science laboratory in Rohini to examine the mobile phones of the two accused and submit its report within four weeks, stating that the purpose was to establish the link between the accused.
He added,
“One stays and the other participates in Jan Sunwaayi, which has nothing to do with the Supreme Court order. It’s important to know what is locked up in your cell phones,”
