Rajasthan High Court Asks Governor’s Intervention Over State’s Lethargic Response

The Rajasthan High Court urged the Governor to intervene after expressing dissatisfaction with the state government’s sluggish response to petitions. Highlighting the government’s lethargic approach, the court emphasized the importance of fulfilling obligations promptly in matters of public welfare.

JODHPUR: Recently, The Rajasthan High Court expressed dissatisfaction with the state government’s slow response to a series of petitions, labeling its approach as “lethargic” and indicating a failure to fulfill its obligations as a welfare state.

Justice Ganesh Ram Meena, while presiding over four petitions, including one by Rekha Kumari on March 15, criticized the delay in the state government’s responses, dating back to 2018 and 2019.

These petitions, relating to claims for appointment to the Post of Teacher Grade-III (Special Education), represent unemployed individuals seeking justice.

“The respondent state, which is supposed to act as a welfare state, is repeatedly asking for time to file a reply, even though they were served four years ago. The lethargic approach of the respondent authority indicates that they are not fulfilling their obligations as a welfare state. Such an approach may lead to a catastrophic situation for the entire litigation and justice system, for which the poor, unemployed litigants are approaching the courts,” noted the bench.

The court highlighted the absence of state counsel, leading to numerous adjournments, and even cited an instance where the state failed to appear in its own litigation. Concerned with the recurring issue, the court directed attention to the Chief Secretary of Rajasthan and the Principal Secretary of the Law and Legal Affairs Department, urging them to ensure proper representation of the state.

“In light of these circumstances, this Court feels that the matter should be brought to the notice of His Excellency, the Governor of Rajasthan, for the issuance of instructions to the State Government to look into the matter so that the interest of the State can be safeguarded during the litigation system and judgments passed by the Court,” the bench emphasized.

The directive further instructed the Registrar (Judicial) to forward a copy of the order to His Excellency the Governor of Rajasthan, the Chief Secretary of the State of Rajasthan, and the Principal Secretary of the Law and Legal Affairs Department, Government of Rajasthan.
