Jharkhand High Court takes a serious view after an advocate allegedly threatened the court during an anticipatory bail hearing in a land-grabbing case. The Bar Council chairman intervened, and the matter is under review for disciplinary action.
The Jharkhand High Court has asked the State Bar Council to take action against an advocate who allegedly threatened the court during an anticipatory bail hearing in a land-grabbing case.
The court order reveals that tensions rose immediately after Justice Sanjay Kumar Dwivedi rejected the anticipatory bail petition filed by the accused in the land dispute.
The court said the petitioner’s lawyer started “arguing with the court in a loud voice” and “threatened the court” by saying that he would approach the Supreme Court.
The case relates to a dispute between the petitioners and an 80-year-old informant. The petitioners were apprehensive about arrest in connection with a case of attempted culpable homicide under the Bharatiya Nyaya Sanhita, 2023.
The court said the lawyer’s behaviour, described as “hooliganism,” was witnessed by several members of the bar, including a senior counsel.
The court further said that such conduct,
“which attempted to hinder or obstruct the due administration of justice and amounted to scandalising the court itself,”
was serious enough to consider “initiate the criminal contempt proceeding” against the advocate.
Following the escalation, Jharkhand State Bar Council chairman Rajendra Krishna appeared in court and said the court to avoid initiating criminal contempt proceedings.
The court eventually relented but the court said it strongly condemned the advocate’s conduct, calling it
“an attack on the entire judiciary.”
The court then referred the matter to the chairman of the Bar Council for further review.
When contacted, Jharkhand Bar Council chairman Rajendra Krishna said the case was under review. He said,
“The matter has been referred to us on grounds of gross misconduct. We will go through the case today. The Council is expected to act in a disciplined manner. Advocates are officers of the court, and dignity has to be maintained.”
