Gujarat High Court’s Lack of Trust On Asaram Bapu’s Son, ‘We Aren’t Convinced, You Have Lost The Trust of This Court’

The Gujarat High Court, led by Justices AS Supehia and Vimal Vyas, on Monday (January 29), declined to entertain an interim bail plea submitted by Narayan Sai, citing his past misconduct involving the submission of forged medical documents. The bench emphasized their lack of trust in Sai due to his history, highlighting the importance of credibility in legal proceedings.

The case took a significant turn when the bench pointed out discrepancies in Sai’s application, which claimed that his father, Asaram Bapu, was in a critical condition. The judges challenged the authenticity of this claim, stating,

“How can we repose faith in you when you already have forged documents earlier. In your instant application, you have said he (Asaram Bapu) is in critical condition but show us from records that he is in a critical condition, because the medical papers do not state that he is critical. He is being treated in AIIMS. We aren’t entertained and we aren’t convinced.”

Justice Supehia, emphasizing the need for concrete evidence, advised Sai’s Advocate, Ashish Dagli, to submit a new application supported by reliable hospital reports confirming Asaram Bapu’s critical health condition. The judge insisted,

“It has to be in black and white that he is in a critical condition.”

During the proceedings, Justice Supehia made a noteworthy remark regarding the care of Asaram Bapu,

“But he has daughters. And I can say, daughters are more care taking than a son. So don’t worry,”

highlighting the role of family in providing care and support.

Following a court recess, Dagli attempted to present new medical reports to support his client’s claims. However, the bench refused to accept these documents without proper verification, emphasizing the importance of due process.

“We cannot accept documents over the counter like this. We will have to ask the other side to verify the same,”

the bench stated, underscoring the need for thorough examination and validation of evidence.

The judges remained firm in their stance, with Justice Supehia reiterating their distrust in Sai due to his past actions.

“Looking to your history (wherein you sought interim bail on basis of forged documents), we do not trust you. You have lost the trust of this court. We aren’t convinced and won’t entertain this instant application,”

Justice Supehia declared.

In response to the court’s unwavering position, Dagli withdrew the plea, marking a significant moment in the ongoing legal saga surrounding Narayan Sai. This decision underscores the judiciary’s commitment to integrity and the critical role of trust and authenticity in the legal system
