The Kerala Story 2 Row: Madras High Court Restrains Illegal Broadcast By BSNL, Cable Operators

The Madras High Court has restrained internet service providers and cable TV operators from illegally streaming Kerala Story 2 – Goes Beyond. Justice Senthilkumar Ramamoorthy passed the interim order on a plea by Sunshine Pictures Limited citing pre-release copyright infringement concerns.

CHENNAI: The Madras High Court has temporarily prohibited internet service providers and cable TV operators from illegally broadcasting the film Kerala Story 2 – Goes Beyond.

Justice Senthilkumar Ramamoorthy issued the interim order following applications filed by the film’s producer, Sunshine Pictures Limited, which expressed concerns about potential copyright violations ahead of the film’s release.

Sunshine Pictures sought emergency relief against various respondents, including Bharat Sanchar Nigam Limited and multiple cable TV providers, to avert unauthorized broadcasts of the film.

The Court noted that the lawsuit aimed to prevent the unlawful broadcasting of the film and acknowledged the plaintiff’s submission of the CBFC certificate as proof of ownership, confirming its status as the film’s producer.

The plaintiff’s counsel informed the Court that the film was scheduled to be released on the same day, having received the necessary approvals from the Division Bench of the Kerala High Court.

The Court highlighted that failing to prevent unlawful broadcasting could lead to irreversible harm. However, it also recognized that the relief requested might impact the legitimate business interests of certain respondents. In light of this, the Court instructed the producer to provide an indemnity for the relief granted.

Subject to this indemnity condition, an ad-interim injunction was issued to restrain the unlawful broadcast of the film until March 23. The case is set to be revisited on that date.

The Kerala Story 2 – Goes Beyond is a sequel to the provocative Hindi film The Kerala Story. The Kerala High Court had approved the movie’s release on February 27, amidst controversy surrounding its title, which some claimed misrepresents the state of Kerala.
