Kerala Govt Challenges Anticipatory Bail to MLA Rahul Mamkootathil in Second Rape Case

The Kerala government has moved the High Court against the anticipatory bail granted to MLA Rahul Mamkootathil in a second rape case. The State argues the trial court’s relief was unjustified amid serious allegations of sexual assault.

The Kerala government has approached the Kerala High Court on Thursday challenging the order of a trial court that granted anticipatory bail to Member of Legislative Assembly (MLA) Rahul Mamkootathil in the second rape case registered against him.

A day earlier, the Thiruvananthapuram District and Sessions Court, led by Judge Nazeera S, had given anticipatory bail to Mamkootathil. Interestingly, the same judge had previously rejected his request for anticipatory bail in another rape case filed against him.

The allegations against the MLA are based on a complaint that was sent by the alleged survivor in an email. This email was forwarded by Kerala Pradesh Congress Committee (KPCC) President Sunny Joseph to the State Police Chief.

According to the complaint, Mamkootathil contacted the woman after taking her Telegram details and convinced her to meet him by saying they needed to talk about a “potential marriage proposal”.

She has stated that he took her to a resort in 2023 and later to a remote homestay with a friend, where he allegedly raped her. She has also said that she suffered “several injuries on her body” because of the assault.

After receiving the complaint, the Crime Branch registered the rape case and began its investigation.

In the anticipatory bail plea before the Sessions Court, Mamkootathil said that the accusations were “false and politically motivated”.

He argued that there was “no material evidence” to support the woman’s claims and that the entire case was meant “to tarnish his public standing”.

The political developments around him have been unfolding quickly. The Congress party had suspended him from primary membership in August this year after multiple women levelled allegations of sexual misconduct.

He also stepped down from his post as Youth Congress Chief. Last week, the party went ahead and expelled him. However, despite all these actions, he continues to be the elected MLA from the Palakkad constituency.

In a separate but related development, the Kerala High Court had recently stayed his arrest in another rape case filed by a woman journalist.
