Today, 14th May, The Calcutta High Court bench addressed concerns of police overaction. This came during the release of a petition by ex-judge Abhijit Gangopadhyay, highlighting potential issues with law enforcement’s actions. The court’s intervention highlights ongoing scrutiny regarding police conduct and legal safeguards.

Calcutta: A petition filed by former Judge Abhijit Gangopadhyay removed from the list, On Tuesday,by Justice Jay Sengupta of the Calcutta High Court.
The petition alleged that the police unfairly registered a case of attempted murder against him.
Gangopadhyay, who currently a BJP candidate for the Tamluk Lok Sabha constituency, sought to have the First Information Report (FIR) quashed, which filed in relation to an incident where he protested against while filing his nomination for the elections at the collector’s office.

Advocate Rajdeep Majumdar, On May 13, representing Gangopadhyay, raised the case and claimed that the first information report (FIR) filed against Gangopadhyay politically motivated. It alleged that the FIR was intended to prevent Gangopadhyay from campaigning for the ongoing 2024 Lok Sabha elections. The plea filed sought the quashing of the FIR and requested the establishment of a Special Investigation Team (SIT) to investigate the matter.
Gangopadhyay’s lawyer, Rajdeep Majumder, argued that,
“His client had no involvement in the alleged incident and that his name appeared in the FIR unjustly, which included the serious charge of attempted murder under Section 307 of the Indian Penal Code.”
Justice Jay Sengupta, citing personal reasons, removed the petition from his list and ordered that it be presented before the Chief Justice of the Calcutta High Court for reassignment to another bench.

Justice Gangopadhyay, stated,
“I am familiar with him. I will remove this case from my docket. I trust that the State will act with reasonableness.”
According to the State police, the FIR lodged against Gangopadhyay for allegedly assaulting dismissed school employees at their protest site. Gangopadhyay charged with offenses including attempt to murder under the Indian Penal Code (IPC). The complaint made by certain teaching and non-teaching staff members who had lost their jobs due to a ruling from the Calcutta High Court in the school jobs for cash scam case.

The incident occurred on May 4 when Gangopadhyay, accompanied by Suvendu Adhikari, a colleague from his party, led a rally before submitting his nomination papers for the Tamluk Lok Sabha seat. During the rally, some BJP supporters reportedly attacked teachers who protesting against the loss of their jobs following the High Court ruling.
