Baramulla MP Engineer Rashid Sheikh Seeks Modification Of Interim Bail Order In Delhi High Court

Baramulla MP Abdul Rashid Sheikh’s counsel approached the Delhi High Court seeking a modification of his interim bail order. He requested permission to travel to Delhi to meet his ailing father, recently shifted from Srinagar to AIIMS Delhi.

Baramulla MP Abdul Rashid Sheikh’s counsel appeared before the Delhi High Court seeking modification of the interim bail order granted to him.

Abdul Rashid Sheikh has requested that the order be amended to allow him to travel to Delhi to meet his father, who has been shifted from Srinagar to AIIMS Delhi.

An application seeking this modification has been filed and the matter was mentioned before the bench of Justices Prathiba M Singh and Madhu Jain.

Earlier, The bench had granted Abdul Rashid Sheikh interim bail on April 28 for a period of one week.

Advocate Vikhya Oberoi mentioned the case and stated that,

“Abdul Rashid Sheikh alias Engineer Rashid was granted interim bail to meet his ailing father, who was admitted to a hospital in Srinagar.”

Advocating for the change, Oberoi submitted that the family has now moved the father to AIIMS Delhi for better treatment. He further submitted that Abdul Rashid Sheikh is currently unable to leave Srinagar, and therefore sought modification of the order to permit him to come to Delhi to meet his father.

The court will take up the matter at 2 PM.

Earlier, while The Division Bench of Justices Prathiba M Singh and Madhu Jain had granted him interim bail on the condition that he furnish a bail bond of Rs. 1 lakh along with one surety of the same amount.

While granting the interim bail, the High Court directed that:

  • He must remain at the hospital where his father is admitted,
  • He shall not interact with anyone except his family members,
  • He must keep his mobile phone switched on,
  • He will be accompanied by two officials, with the expenses to be covered by the NIA, and
  • He must surrender after one week.

Rashid He won the Baramulla Lok Sabha seat in the 2024 Lok Sabha elections, defeating Jammu and Kashmir Chief Minister Omar Abdullah by more than two lakh votes.

A special NIA court framed charges against him in March 2022 under multiple provisions of the Indian Penal Code and the UAPA, including allegations of criminal conspiracy, waging war against the state, and terror funding. He has challenged that order before the High Court.

The NIA was represented by Senior Advocate Sidharth Luthra and Akshai Malik, who appeared on its behalf.
