NEW DELHI: The Delhi High Court on Wednesday dismissed a petition seeking the establishment of a Board for the Protection of Sanatana Dharma, modeled on the Waqf Board, to safeguard Hindu religion and customs.
A division bench comprising Chief Justice Manmohan and Justice Tushar Rao Gedela made it clear that the issue falls squarely within the domain of government policymaking, and judicial intervention is unwarranted.
“We cannot do anything in this,”
-remarked Chief Justice Manmohan during the proceedings.
The Court concluded by disposing of the petition, granting liberty to the petitioner to approach the government for further action.
The Petition and Its Basis
The plea was filed by the Sanatan Hindu Sewa Sangh Trust, which claimed that followers of Sanatana Dharma were facing targeted attacks by adherents of other religions.
According to the petition, no dedicated religious body exists to protect the rights, customs, and practices of Sanatana Dharma, thus necessitating the creation of such an institution.
The petition further highlighted that the petitioner had already approached the government with a representation for the establishment of the board but received no response, compelling the Trust to seek judicial intervention.
Court’s Stand: Policy, Not Judiciary’s Domain
In dismissing the plea, the High Court emphasized that-
“Creation of such a body is a matter of policy that should be addressed by the executive branch, not the judiciary.”
The bench refrained from making any directive, leaving the issue open for the petitioner to pursue through governmental channels.
The verdict underscores the judiciary’s consistent stance of non-interference in policy decisions, urging stakeholders to direct their appeals to the appropriate governmental authorities.
