Justice Girish Kulkarni and Justice Neela Gokhale of the Bombay High Court, which heard the NIA appeal against Sachin Waze's bail.

Mumbai: Five high-end cars owned by Sachin Waze, the dismissed Mumbai Police officer, drew the surprise of the Bombay High Court on Thursday, as did his alleged practice of travelling in a Mercedes even to his office, the office of the Commissioner of Police and the Chief Minister’s residence, Varsha Bungalow. The remarks came as the Court heard the National Investigation Agency’s appeal against the bail granted to him [National Investigation Agency v. Sachin Waze].

A Division Bench of Justice Girish Kulkarni and Justice Dr. Neela Gokhale is hearing the appeal.

How the appeal reached this Bench

Waze is an accused in the Antilia bomb scare case and in the case relating to the murder of Mansukh Hiran. The NIA challenged the Special Court’s order granting him bail. After three judges recused themselves from the appeal, the High Court on September 30, 2026 stayed the bail order for the time being and listed the matter for hearing in October.

The exchange in Court

Additional Solicitor General Anil Singh, appearing for the NIA, was reading out statements of a witness when the Bench noted that the witness spoke, consistently, of Waze travelling in a Mercedes car. Justice Kulkarni orally asked who owned the vehicle:

“Whose Mercedes is it? We are yet to hear that the API is riding a Mercedes… Who owns it?”

These were oral remarks made during the hearing. They are not findings, and the Court has recorded no conclusion on who owns the vehicles or on the merits of the appeal.

The allegations against Waze are untested, the High Court has expressed no view on the merits of the case, and the presumption of innocence applies. The hearing of the appeal is continuing.
