Impersonating Amit Shah’s Nephew: Supreme Court Grants Bail to Man Accused of Cheating

Today, On 1st December, The Supreme Court granted bail to a man accused of cheating by pretending to be Amit Shah’s nephew, noting he has already spent years in custody while the trial has barely progressed. The bench said the case’s slow pace justified granting bail now.

The Supreme Court has granted bail to an individual accused of defrauding a businessman of Rs.3.90 crores by posing as the nephew of Union Home Minister Amit Shah.

A bench consisting of Justices J.K. Maheshwari and Vijay Bishnoi issued the ruling, noting that the accused has spent over four years in custody, while the maximum sentence for the alleged offense is seven years.

The charges were framed in 2022, yet only the first witness out of 34 has been examined to date.

Additional Solicitor General Vikramjit Banerjee represented the Delhi government and opposed the bail request. He highlighted that a prosecution application to add forgery charges is still pending and mentioned that other cases are against the petitioner as well.

The ASG asserted that a larger scam was underway, involving the misuse of names of high-ranking officials. However, the bench was not persuaded by these arguments.

Justice Maheshwari remarked,

“We should go as per law, we will not go here and there.”

Responding to concerns that the petitioner should not be released until the cross-examination of the complainant is finished, the judge stated,

“No, nothing. Had this case come earlier, we would have granted bail earlier also.”

As per the case details, Ajay Kumar Nayyar told the complainant that he could help him get a government tender worth Rs 90 crore. In return, the complainant gave him Rs 3.9 crore through both cash and RTGS (bank transfer).

Ajay Nayyar has been in jail since 10th November 2021.

The petitioner moved the Supreme Court after the Delhi High Court refused to grant him bail.
