NEW DELHI: The Supreme Court of India on Monday clearly stated that India cannot act as a “dharamshala” (public shelter) for refugees from around the world, while rejecting a plea by a Sri Lankan Tamil national who was facing deportation after completing a jail sentence. A Bench of Justice Dipankar Datta and Justice K Vinod Chandran was hearing the case of Subaskaran, a Sri Lankan Tamil who had challenged an order of the Madras High Court directing him to leave India immediately after serving a seven-year sentence under various laws including the Unlawful Activities (Prevention) Act, 1967 (UAPA).

A bench of Justices Chandra Dhari Singh and Anup Jairam Bhambhani ruled that Rashid, also known as Engineer Rashid, will be taken to Parliament by the police and brought back to jail each day from March 26 to April 4. The court specified that during this period, he will not be allowed to use a mobile phone, landline, or speak to the media.
The Delhi High Court will on January 7 hear bail pleas of student activists Umar Khalid, Sharjeel Imam and other accused in the UAPA case related to February, 2020 violence. Justices Navin Chawla and Shalinder Kaur are scheduled to hear the cases. Delhi Police is likely to commence its submissions in the cases.

Today, On 4th November, the Supreme Court eased bail conditions for journalist Siddique Kappan in a UAPA case. Initially arrested in October 2020 while traveling to Hathras after a Dalit woman’s death, Kappan no longer needs to report weekly to police. The court emphasized the importance of free expression during the bail modification.
Today, On 7th October, the Delhi High Court adjourned the bail pleas of Umar Khalid and Sharjeel Imam, significant figures in the 2020 Delhi riots case, to November 25, 2024, due to the justices’ unavailability. Khalid has faced multiple challenges in securing bail since his arrest in September 2020 under the UAPA.
