The Supreme Court Today (May 3rd) declined to grant any relief to the YSR Congress Party on its plea challenging new rules for counting of postal ballot votes in Andhra Pradesh.

The Bench, comprising Justices Arvind Kumar and Sandeep Mehta, determined that there was no necessity to interfere with the Andhra Pradesh High Court’s previous decision to deny relief to the political party, suggesting that the matter could be addressed through an election petition.
“In the facts and circumstances of this case, we refuse to interfere,”
-the Supreme Court stated during the hearing.
The YSRCP approached the Court challenging the validity of the relaxed norms implemented for recognizing the counting of postal ballots in Andhra Pradesh. The party contended that the Election Commission of India (ECI) had relaxed the norms in the State.
Specifically, the mandatory requirement for the name and designation of the attesting officer to be mentioned in Form 13A was removed. Post-relaxation, only the specimen signatures of all such officers are required.
The YSRCP argued that this relaxation was done solely to validate postal ballots that did not comply with the mandatory legal requirements.
Initially, the party took its grievance to the Andhra Pradesh High Court. However, on June 1, the High Court declined to grant any relief and suggested that the party file an election petition rather than seeking remedy under writ jurisdiction.
“The writ plea is disposed of with liberty to the petitioner to pursue remedies in a properly framed election petition,”
-the High Court stated in its decision.
Subsequently, the YSRCP filed an appeal before the Supreme Court, challenging the High Court’s decision.
However, the Supreme Court, after hearing the matter today, made it clear that it would not interfere with the High Court’s ruling.
