The Supreme Court granted a mutual consent divorce while praising the woman for voluntarily waiving alimony and all financial claims. The Bench remarked, “We appreciate this kind gesture, which is very rare nowadays,” acknowledging her fairness in the settlement.
New Delhi: The Supreme Court granted a divorce by mutual consent, commending a woman for forgoing any financial claims or alimony from her husband in their settlement agreement.
A Bench comprising Justices JB Pardiwala and KV Viswanathan noted that both parties had agreed to the terms of the settlement and highlighted this case as one of the rare instances where the wife requested nothing from her husband.
The Bench observed that, in the spirit of amicable resolution, the wife even returned gold bangles that were given to her during the marriage, originally belonging to her husband’s mother.
The Bench mentioned in its order,
“This is one of the rare settlements we have come across over a period of time wherein nothing has been demanded by the wife from the husband,”
While utilizing its powers under Article 142 of the Constitution to dissolve the marriage, The Court acknowledged the woman’s generous gesture, stating,
“We appreciate this kind gesture which is very rare to be seen nowadays,”
Before concluding the matter, the Court addressed the wife directly in open court, encouraging her to look ahead in life.
The Bench advised her,
“This is one of the rare cases we have come across where there is no exchange of anything. We appreciate this. Go ahead in life. Forget the past. Live a happy life. Wish you the best,”
Exercising its unique authority under Article 142 of the Constitution, the Supreme Court annulled the marriage and dismissed any remaining legal proceedings between the parties, facilitating a definitive and clear separation.
