Ensure Trauma Care Facilities Are Accessible To Citizens Across India To Save Lives In Emergencies: Supreme Court

NEW DELHI: The Supreme Court of India has emphasized the urgent need for a uniform Standard Operating Procedure (SOP) for trauma care facilities across the country, ensuring that every citizen has timely access to emergency medical treatment.

This development arose in the case of Savelife Foundation & Anr v. Union of India & Ors, where the non-profit organisation Savelife Foundation petitioned the Court, arguing that the absence of a standardised emergency response mechanism violated citizens’ fundamental rights under Articles 14 and 21 of the Constitution.

Court’s Observations

A Bench comprising Justice J.K. Maheshwari and Justice Vijay Bishnoi observed that trauma care directly affects personal liberty and equal opportunity in emergency situations. Recognising the fragmented nature of trauma care services across States and Union Territories, the Court stressed that a common SOP was necessary for uniformity and accessibility.

The Court remarked:

“Formulation of Standard Operating Procedure in consultation with the State Governments may be appropriate.”

Role of the Attorney General

The Court has requested Attorney General for India R. Venkataramani to take the lead in this matter. His office will:

  • Scrutinise the stand of different State Governments and Union Territories,
  • Consult with the petitioners, and
  • Submit a comprehensive report within six months on possible recourse to implement uniform trauma care standards.

The Court made it clear that once the Attorney General’s report is received, it may issue appropriate directions to ensure the preparation and adoption of a common SOP nationwide.

Need for National SOP on Trauma Care

India faces a high burden of road accidents and trauma-related deaths, with delays in emergency medical care being one of the leading causes of preventable fatalities. The lack of standardised trauma care infrastructure means that outcomes often depend on geography rather than need, raising serious constitutional concerns.

A national SOP on trauma care could:

  • Ensure timely treatment regardless of location,
  • Reduce mortality from accidents and emergencies,
  • Provide clarity and accountability for hospitals and first responders, and
  • Strengthen the right to health as a part of the fundamental right to life.
