[3.99 Crore Seizure Case] Tamil Nadu Govt. Moves SC Against Order Asking Police Not to ‘disturb’ BJP Leader Kesava Vinayagan

NEW DELHI: Today (15th July): Tamil Nadu Government has moved to the Supreme Court to contest a Madras High Court decision that restricted the issuance of summonses to Bharatiya Janata Party (BJP) leader Kesava Vinayagan in a cash seizure case.

Justices Surya Kant and Ujjal Bhuyan have asked for Vinayagan’s response in this case.

The Madras High Court restrained the Crime Branch-Criminal Investigation Department (CB-CID) from “disturbing” Bharatiya Janata Party (BJP) organizing secretary Kesava Vinayagan in connection with a case involving the seizure of Rs 3.99 crore from three train passengers traveling from Tambaram railway station in Chennai to Tirunelveli on April 6.

However, Justice G Jayachandran, in a_ single-judge ruling, ordered the Tamil Nadu Crime Branch Criminal Investigation Department (CBCID) to refrain from excessively summoning Vinayagan in connection with the case, aiming to prevent undue disturbance to him.

On April 27, authorities intercepted Rs 3.99 crore from three men on a train heading to Tirunelveli district, Tamil Nadu. One of the men was alleged to have BJP affiliations. Local police filed an FIR and named Vinayagan in the case.

The investigation was later transferred to the CBCID. _Vinayagan approached the High Court to quash the FIR, but the court denied his plea, cautioning against an unfocused inquiry. The High Court ruled that CBCID could summon Vinayagan only with court permission.

The State then appealed to the Supreme Court. Senior Advocate Kapil Sibal and others represented the State, arguing that the High Court’s protection was overly broad given the dismissal of the quashing petition under Section 482 of the Criminal Procedure Code.

The Supreme Court issued a notice to Vinayagan and scheduled the case for September 20.
