[Tailor Kanhaiya Lal Murder Case] Apex Court Issues Notice to NIA, After HC Grants Bail To The Key Accused

NEW DELHI: The Supreme Court issued a notice on Monday(11th Nov) to Mohammed Javed, an accused in the 2022 beheading of Udaipur tailor Kanhaiya Lal, and to the National Investigation Agency (NIA) following a petition filed by Kanhaiya Lal’s son, Yash Teli.

The petition challenges the Rajasthan High Court’s September decision to grant Javed bail.

BRIEF FACTS

In June 2022, two primary accused, Riyaz Attari and Ghous Mohammed, allegedly entered Kanhaiya Lal’s shop disguised as customers and fatally attacked him with knives. The attack was filmed, and the video was circulated on social media with communal slogans and messages, including “Gustakh-e-Nabi ki ek hi saza, sar tan se juda.”

The NIA investigated the case, charging multiple individuals, including Javed, whose alleged role involved providing the assailants with information on Kanhaiya Lal’s location.

The Rajasthan High Court had granted Javed bail, citing a lack of strong evidence to prove conspiracy with the main accused. In response, Yash Teli, represented by Supreme Court advocate Namit Saxena, appealed to the Supreme Court, arguing that Javed’s role was significant as he confirmed Kanhaiya Lal’s whereabouts to the assailants.

Saxena contended that the High Court erred in granting bail without fully assessing the severity of Javed’s involvement. The matter is being heard by a bench comprising Justices M.M. Sundresh and Aravind Kumar.
