NEW DELHI: (On Aug 22): The Delhi Police has described the alleged physical assault on AAP Rajya Sabha MP Swati Maliwal at the Chief Minister’s residence as “brutal,” urging the Supreme Court to reject the bail plea of accused Bibhav Kumar. In its response to Kumar’s bail plea, the police also requested that Maliwal’s perspective be heard in the case.

Kumar, a close aide to Chief Minister Arvind Kejriwal, is currently in judicial custody. He is accused of assaulting Maliwal on May 13 at Kejriwal’s official residence and has appealed against the Delhi High Court’s July 12 decision denying him bail.

“The present case involves a brutal assault on a sitting Member of Parliament by an influential former officer at the Chief Minister’s residence. The incident, which took place at the Chief Minister’s residence in Delhi, has had a profound effect on the public consciousness, and any decision in this case will have far-reaching consequences,”
stated an affidavit filed by Deputy Commissioner of Police Manoj Kumar Meena.
The affidavit highlighted that the accused is “influential” compared to the victim, and stressed that “the complainant must be heard, as granting liberty to the accused directly impacts her safety and that of her family.”
The affidavit also argued that the accused holds considerable influence compared to the victim, and any decision in favor of the accused could jeopardize her safety and that of her family.
The affidavit further noted that Maliwal corroborated her allegations in a statement before a judicial magistrate and highlighted the severe emotional trauma she suffered, leading her to remain confined at home for four days after the assault. The incident took place at a highly sensitive location, which added to its severity.

A bench led by Justice Surya Kant is hearing the case, having made strong remarks about the incident and the accused on August 1. Kumar faces charges under various sections of the Indian Penal Code, including criminal intimidation, assault with the intent to disrobe, and attempted culpable homicide.
It also noted that the victim confirmed her allegations in her statement before a judicial magistrate.
“The victim was deeply traumatized by the harassment and assault. As a respected sitting Member of Parliament from the ruling party in Delhi, she was brutally attacked at the highly sensitive location of the Chief Minister’s residence,”
the affidavit further stated.
“This severe incident had a significant effect on her mental health, confining her to her home for four days after the assault.”
The high court, in denying bail to the accused, noted his “considerable influence” and found no valid reason to grant relief, expressing concerns that releasing him could result in witness tampering or evidence being compromised.
