The Supreme Court Today (Feb 21) withdrew its 10-day probe order against MLA Abbas Ansari and asked UP Police for a status report on pending investigations before deciding on his bail plea.

Instead, the court wanted to confirm if any investigation was still pending against him.
Court Hearing and Arguments
A special bench of Justice Surya Kant and Justice N Kotiswar Singh reviewed the case and set the next hearing date as March 6.
Kapil Sibal’s Arguments
Senior advocate Kapil Sibal, who represented Abbas Ansari, stated:
- “The investigation was complete, and a chargesheet had already been filed” under the UP Gangsters Act.
- “The state had submitted a wrong affidavit”, falsely claiming that there were pending investigations.
- The state had also said that four co-accused were absconding, but the chargesheet had no mention of any other accused in the case.
State Government’s Response
- Additional Solicitor General K M Nataraj, representing the Uttar Pradesh government, said that he needed further clarification on the matter.
- The court took note of the conflicting statements and asked the state government to file a status report about the investigation.
Supreme Court’s Order on Investigation and Bail Plea
- Initially, the Supreme Court had ordered the UP Police to complete their probe in 10 days.
- The court had planned to consider Abbas Ansari’s bail plea only after the investigation was over.
- Ansari is accused of running a gang in Chitrakoot district.
- The state government had earlier told the court that the investigation was ongoing, and releasing him on bail could harm the probe.
- The officials also alleged that:“Ansari had bribed a jail official and could influence witnesses if released on bail.”
Abbas Ansari’s Fear of Encounter and Virtual Appearance Request
On January 31, Abbas Ansari expressed fear that he might be killed in an encounter and requested to appear virtually in court proceedings.
- “I was appearing before the court virtually from jail in Kasganj, but the facility was later stopped.”
- The Supreme Court rejected his request for a virtual hearing, stating that he had not made this request in his petition.
- The court advised Kapil Sibal to approach the High Court with the virtual hearing request.
Allahabad High Court’s Decision and Case Background
Earlier, on December 18, 2024, the Allahabad High Court had denied bail to Abbas Ansari.

- An FIR was lodged on August 31, 2024, at Kotwali Karvi Police Station in Chitrakoot district.
- The case was filed under Section 2 and 3 of the UP Gangsters and Anti-Social Activities (Prevention) Act, 1986.
- The accused in the case were:
- Abbas Ansari
- Navneet Sachan
- Niyaz Ansari
- Faraz Khan
- Shahbaz Alam Khan
- They were accused of extortion and assault.
Gang Chart and Arrest
- The gang chart was prepared on August 28, 2024, and was officially approved by the Chitrakoot District Magistrate on August 29, 2024.
- The chart identified Abbas Ansari as the gang leader, while the other four were listed as gang members.
- The High Court rejected his bail plea, noting that the investigation was still ongoing and that Ansari was arrested on September 6, 2024.
Political Background of Abbas Ansari
- Abbas Ansari is a Member of the Legislative Assembly (MLA) from the Mau constituency.
- He represents the Suheldev Bharatiya Samaj Party (SBSP).
- He is the son of the late gangster Mukhtar Ansari.
The Supreme Court has now asked the state government to submit a status report on the investigation. The next hearing is scheduled for March 6.
Until then, the question remains whether Abbas Ansari’s bail plea will be considered based on new findings in the case.

The Supreme Court of India earlier today asked the Uttar Pradesh police to complete their investigation against MLA Abbas Ansari within 10 days in a case under the Gangsters Act.

Ansari Wanted Virtual Appearance Due to Fear of Encounter
On January 31, 2025, Ansari requested to attend his trial court hearing virtually because he was afraid of a police encounter.
Allahabad High Court Rejected Bail in December 2024
Earlier, on December 18, 2024, the Allahabad High Court had rejected Ansari’s bail application.
The court noted that Ansari and some others were accused of forming a gang to gain financial and other illegal benefits.
