Supreme Court Slams Murder Convict for Repeated Surrender Delay Plea: “How Dare You File This?”

NEW DELHI: The Supreme Court of India strictly criticized a murder convict named Vinod @ Ganja for again asking for more time—three extra weeks—to surrender before the jail authorities.

Earlier, a bench led by Justice AS Oka had already rejected his similar request on May 14.

During today’s hearing, the bench of Justice Ahsanuddin Amanullah and Justice SVN Bhatti expressed strong disapproval.

They made a strong remark:

“How dare you file this… coordinate bench headed by Justice [Abhay] Oka (rejected it) and you have guts to file it during vacation,”

-the Court said.

Senior Advocate Rishi Malhotra, who represented the convict, told the Court that they were only asking for a small extension—three more weeks—until the Delhi High Court decides on his petition for premature release on July 10.

But the Supreme Court reminded the advocate that the convict had already come to them earlier with the same request, and it was denied. Malhotra argued that the earlier bench led by Justice Oka had actually given three weeks’ time to surrender.

However, the Supreme Court was not convinced by this argument. Malhotra then told the Court that the convict would surrender today itself.

The Court took this situation seriously. It made it clear that the act of coming back with the same plea again was not acceptable. The Court said it would pass an official order on Thursday, but in the meantime, it directed that the convict must surrender immediately.

The bench gave a strong warning in its order:

“Filing of present case is absolutely uncalled for unwarranted and needs to be dealt with strictly. Accordingly, it is directed petitioner should surrender today itself and the Court will consider what other order needs to be passed in facts and circumstances of the case,”

-the Court stated.

At this point, Advocate-on-Record Sweta Rani stepped forward and tried to withdraw the petition.

She made a very humble request to the Court:

“Lordship, I am AOR in the matter, I am extremely sorry. I may be allowed to withdraw this petition. My humble request.”

But the Court was not willing to accept this withdrawal:

“Not permitted. Rejected.”

Earlier, the same convict had gone to the Delhi High Court, asking for his early release under the State’s remission policy. He has already served more than 14 years of actual jail sentence and more than 16 years including remission, according to his plea.

On May 5, the Delhi High Court took note of the plea but refused to stop his surrender scheduled for May 20. Earlier, on April 28, he was granted furlough (temporary release) by jail authorities.

The High Court had clearly stated:

“Since the main petition is coming up for hearing on 10.07.2025, this Court, at this stage, does not find it appropriate to pass any order or to direct the petitioner to not surrender on 20.05.2025 in FIR bearing No. 40/1992, registered at Police Station Mukherjee Nagar, Delhi for the offences punishable under Sections 302/307/34 of IPC and Section 27/30/54 of the Arms Act.”

After that, the convict had approached the Supreme Court, which agreed with the High Court’s stand but still gave him three weeks to surrender.

Later, on May 27, he once again filed a fresh application, asking for even more time to surrender. That very application came up in the latest hearing and was strongly rejected by the Supreme Court.
