New Delhi: The Supreme Court postponed its hearing on a plea by gangster-politician Mukhtar Ansari against an order from the Allahabad High Court, which had sentenced him to a five-year prison term in a case dating back 24 years. A bench comprising Justices Bela M Trivedi and Pankaj Mithal adjourned the hearing on Ansari’s plea.
“He is a dreaded criminal. There are so many cases,”
-the bench observed.
Senior advocate Garima Prasad, representing the Uttar Pradesh government, highlighted Ansari’s alleged reign of terror in the state, to which the bench responded,
“he is behind bars now.”
On October 13 of the previous year, the Supreme Court had requested a response from the Uttar Pradesh government regarding Ansari’s appeal against the high court ruling.
Earlier, on September 23, the Lucknow Bench of the Allahabad High Court had overturned Ansari’s initial acquittal and sentenced him to a five-year imprisonment under the Gangster Act. Additionally, a fine of Rs 50,000 was imposed on Ansari as the high court reversed the previous acquittal issued by a special MP-MLA court in 2020.
The case traces back to an FIR lodged with Lucknow’s Hazratganj police in 1999 under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act. Despite being acquitted by a special court in 2020, the state filed an appeal against Ansari’s acquittal in 2021.
The special court, in acquitting Ansari, a five-time MLA from Mau Sadar constituency, had asserted that the-
“prosecution could not establish the offense against him beyond reasonable doubt.”
