Supreme Court Seeks ED's Reply to AAP MP Sanjay Singh's Bail Request in Delhi Excise Policy Scam

NEW DELHI: The Supreme Court Today (26 Feb) sought the response of the Enforcement Directorate (ED) to a bail plea filed by Aam Aadmi Party (AAP) leader Sanjay Singh in connection with his arrest in the Delhi excise policy scam case.

A bench of Justices Sanjiv Khanna and Dipankar Datta issued notice today, after briefly hearing Singh’s counsel, Senior Advocate Dr. Abhishek Manu Singhvi.

Sanjay Singh was apprehended by the Enforcement Directorate (ED) on October 4, 2023, in connection with a money laundering investigation, allegedly involving his participation in devising and executing the now-abandoned Delhi Excise Policy. The policy purportedly aimed to favor specific liquor manufacturers, wholesalers, and retailers.

The Delhi High Court on February 7 rejected the bail plea of Sanjay Singh, who had been re-elected to the Rajya Sabha from Delhi. Justice Swarana Kanta Sharma, while delivering the judgment, said,

“In view of the ‘material’ against Singh, including the statements of the approver and the witnesses, relief cannot be given at this stage.”

The Supreme Court is scheduled to review Singh’s bail plea on March 5, alongside his petition contesting his arrest and custody.

Previously, the Delhi High Court declined Singh’s petition challenging his arrest and detention in October 2023. The court also cautioned against attributing political motives to the ED, warning of potential repercussions on the nation’s reputation.

Singh’s arrest marked the third significant apprehension of an AAP figure in connection with the excise policy affair. AAP communications in-charge Vijay Nair was detained in November 2022, while former Deputy Chief Minister of Delhi Manish Sisodia was apprehended in February 2023.
